Hawaii: Legislation that Violates Due Process Could be Voted on in the House Tomorrow

House Bill 1813 has been placed on the third reading calendar and could be voted on in the House as early as tomorrow, March 4th.  As previously reported, House Bill 1813, sponsored by state Representative Karl Rhoads, would prohibit an individual whose name appears on the deeply flawed and inaccurate “Terrorist Watchlist,” from owning or possessing firearms and ammunition.

HB 1813 completely ignores an individual’s right to due process of the law and instead allows a secret government list to determine whether or not a person can exercise their Second Amendment Rights. Persons who appear on this top secret government watchlist, generally have no idea if, when or how they were added and may have not been charged, let alone convicted of any crime.  The bill passed the House Judiciary Committee with amendments.  While the amendments attempt to address this deeply flawed legislation, it fails to consider that the terrorist watchlist is a secret list and that the federal government will never inform people when they are removed from the list, let alone placed on it.

Any legislation that seeks to remove the Constitutional rights of an individual without due process is detrimental and should be opposed.

Please contact your state Representative and politely urge him or her to oppose House Bill 1813 when it comes up for a vote.

.

Well, see, the way it works is, all they have to do is make a law that says incarceration without charges is "due process of law."

I do believe that the radical and crazy notion that the Founders meant what they said, is gradually soaking through the judicial system.

Q

I wonder if I put "Karl Rhoads looks like Herman Munster" in my testimony, if I will get in trouble?  ???

I don't know about "trouble", but I can assure you it will still carry the same weight as any previous testimony: none.

Decision on all three BAD gun bills heard by the Senate Committee on Public Safety, Intergovernmental and Military Affairs was deferred until next Tuesday, March 22. IT IS TIME FOR ACTION!  WE NEED TO KILL THESE BILLS BEFORE THEY MOVE FORWARD AND IT'S TOO LATE.

Contact the Committee Chair, Senator Clarence Nishihara at sennishihara@capitol.hawaii.gov, or call him at 808-586-6970 or fax him at 586-6879.
Also, contact the Committee Vice Chair, Senator Will Espero at senespero@capitol.hawaii.gov, or call him at 808-586-6360 or fax him at 808-586-6361.

You should also contact your district Representative and Senator if you are a registered voter. The following bill was also heard and deferred indefinitely, but there still remains the possibility it could be resurrected.
HB 1813, HD1 - Disqualifies you from possession of guns or ammunition if your name appears on the federal Terrorist Watch NO-FLY List (a list which the federal auditor found is unreliable and no one knows how you are placed on the list and getting off the list is next to impossible).  38% error acknowleged.
