  §121-1  Militia.  The militia of the State shall consist of every resident able-bodied citizen of the United States who is seventeen years old or older and under forty-six years of age and all other able-bodied residents of that age who have declared their intention to become citizens of the United States.  The militia shall be composed of four classes:
     (1)  The federally organized and recognized national guard,

     (2)  The remainder of the organized militia to be known as the Hawaii state defense force,

     (3)  The naval militia,

     (4)  The unorganized militia.

The unorganized militia shall consist of those members of the militia who are not members of the national guard, the naval militia, or the state defense force.  The unorganized militia shall be subject to active military duty only when called or ordered into the service of the State for such period as is required.  They may be assigned to existing organizations of the Hawaii national guard, the naval militia, or the state defense force, or otherwise as the

Hawaii State Defense Force falls under control of the governor at ALL times, and will be essentially another branch of the medical guard, following is doctrine and policies.

Better to start an unorganized militia separate from the direct control of the governor, who then has the ability to incorporate the unorganized militia into the HSDF during states of emergency.

I wouldn't want a Mark Takai telling me what to do or how to train.

§122A-13  Civil groups.  No civil organization, society, club, post, order, fraternity, association, brotherhood, body, union, league, or other combination of persons or civil group shall be enlisted in the Hawaii state defense force as an organization or unit.

The UM is incorporate into the HSDF only when activated by the governor and at implemented at his/her command. Until that time, it stands as it's own separate standalone organization, separate from federal and state control.

By that wording I guess I'm automatically part of the militia even though I'm not an active shooter at the moment.

And since we are all part of the militia, that just reinforces our 2A rights as the "militia clause" clearly applies to all of us, regardless of how one interprets it.

So, what sort of purgatory are we olde farts over 46 in?  Can we start our own independent militia not subject to anyone?

You are also part of the national militia according to federal law

If you signed up for the selected service "draft" you are a part of the militia. If you served in the armed forces, either reserve or acticve and honorably discharged your in the militia. Upon entry you swear an oath to support and defend the constitution. There was no time limit attached. To me that means as long as I live and am able to.

I don't think I ever signed up for the draft. Let's see, the internet says that all males between 18 and 25 must register. Anyone not a male between 18 and 25 can't register. I was away for most of that time and didn't know about it. But I got my Hawaii driver's license when I was around 25, which automatically registers you, so I might have just barely made it. I'm too lazy to find out.
