Gun trust to avoid registration in your name
« on: July 05, 2016, 04:46:07 PM »
Hello All,

I am new here and currently living in Florida but from Utah, two very gun friendly states.  I am looking at getting transferred to Hawaii with my job eventually and have a question, my appologies if this has been covered.  I did search and came up with nothing.

My question is, if you put all your guns in a gun trust (forget about the NFA part) can you still buy guns in the name of the trust without having to put your name on any type of registration?  The guns would belong to the trust, not to you.  Also, would you need to be finger printed and such in the buying process?  Why wouldn't you want to use a gun trust for all your purchases if this were the case?  I mean if you can (could) use it to basically circumvent the finger printing and such for NFA items to the federal government, why couldn't the same be applied to regular firearms to your state/city/local government?

I do have all my guns in a trust with no NFA items already, simply because I have no immediate family near me, and if something were to happen to me I want my family back home to be able to claim them with ease and not have them go to the state.  If I were to move to Hawaii with my guns in the trust, in theory I could simply go register them in the name of the trust.  I have googled and searched to no avail for this answer.  I am anti registering anyways and frankly just wouldn't register if I couldn't do it this way.

Thanks for your time,

Cody

For some reason HPD does not register firearms under an entity , even though all their guns and vehicles are property of the City.

It would be a good reason to sue them for it,  since all your guns are already under a trust.

I don't know the exact details but I think firearms are in a certain limbo when the owners die that are technically like a trust. But as Suka said, I have never seen firearms registered in a trust or entity.

Hmmmmm. If a person dident bring them into a state but a trust or company did would you be required to register them........

§134-3  Registration, mandatory, exceptions.  (a)  Every person arriving in the State who brings or by any other manner causes to be brought into the State a firearm of any description, whether usable or unusable, serviceable or unserviceable, modern or antique, shall register the firearm within five days after arrival of the person or of the firearm,

Also if you dont acquire a firearm in compliance with  134-2 your also not required to register it........
Every person who acquires a firearm pursuant to section 134-2 shall register the firearm in the manner prescribed by this section within five days of acquisition.

Only in Hawaii ,  Most if not all firearms in trust are NFA items. Most States do not have registration and firearms are just passed on to family members.

An ATF Form 2 is not required under a Trust if the Original Trustee dies,
