Is CCW at a commercial business legal?
« on: February 12, 2017, 11:01:16 AM »
I've done a brief search and couldn't find anything.  I'm sure there is, buried some where on here.  But if someone has some knowledge they want to share with me I would much appreciate.  This company/ business has recently come under some dangers and feels threatened from time to time.  If the owner of such property is OK to have one personal conceal carry during operating hours, is it legal?  What laws protect the individual if lethal action is used?  This is a completely legal business that has crazy people swing by.  Thanks.

U can bear arms at ur residence, place of business, or place of soujourn. And the firearm has to be kept secure or in close proximity to ones self. As in dont leave the gun on the front desk unattended and go to the break room.

But remember if u leave to grab lunch outside of the office, u cannot carry the gun. Or if the restroom is outside the office same thing.

What about parking lot (private protery)?  We have to step outside to go from office to office.  All on the same property.  Its a small property that only operates on Sunday.

Parking lot is a "common area". So no u cannot carry on oneself without a ccw permit. But the law doesnt define residence or place of business. I contacted the AG office because they are the ones who would press charges on u. The response was that they cant define the law for private citizens.

Like a taxi driver, his place of business is his car, so can he carry openly while driving? The law is written very vague, so to be safe, carry only in ur office.

Are the offices open to the public, as in anyone can walk in during business hours?

That would be a pain, leaving a gun in one location to walk to another.  You'd have to secure it or give it to someone to protect.  That's in addition to being disarmed until you return.

One way would be to unload the weapon and carry it between rooms in a case.   If I were doing that, I'd probably not carry a round chambered, just to avoid that one time I forgot to clear the chambered round.  Risk increases the more times you have to clear it.

Security cameras would be a great thing, to let anyone thinking about acting up know they are being watched and recorded.

I was talking to a gun shop employee who was open carrying in the parking lot. I asked him how far he can go with his firearm and he said "to the sidewalk, as long as I'm on company property I'm legal". When I bring a firearm to work, with approval, I treat it as going to the range. I transport it in an approved container and discreetly uncase it only when on company property.

If you have consent to carry on the property (techinically you would need to be told not to to stop you) , you can carry where ever you want. If your doing it concealed you should never run into a problem.

Common areas are a grey area, Why because they are still part of you business location. But they are open to the public.

As far as liability if lethal force is used...if the business wants you to carry it on their property, then you should get something in writing from the business saying they will defend you in an incident and also place it into your job duties.   The overall responsibility is still yours.

What if the "parking lot" is owned by the your business and there is an "employee access" to the lot and only customers of the business can use the parking area. I would imagine HPD wouldn't have any grounds for an arrest. unless you are doing something dangerous to the community, etc etc., they couldn't stop you. wait wait wiat, we are talking about the fools and crooked aholes at HPD! Darn... that's what I get for thinking..... :shake:  By the way I open carry on my property, locked and loaded when I feel like it! Been asked by the piggly wigglys why and just smile and tell them "because I can", if they start to hassle me i just flip em off and go about my business. One time this dumb fart asked me if my gun was loaded and I said "is yours"?

In NV you can open carry in public without a permit, but for some crazy reason, you cannot conceal carry even INSIDE your home without a permit.  To do so is a felony.  I conceal carry on my property on the Big Island, as far as I know Hawaii does not have a law against that.  But like Andy Bumatai says, don't quote me because I might be wrong.

Some places might have laws but they are not enforceable. Private property rights trump all.
