Trump's Travel Ban
« on: May 25, 2017, 12:24:55 PM »
Dammit, now Trump has to disband the 4th and the 9th Circuit.

Seriously, I still expect the "immigration" :rofl: ban to be upheld in the SCOTUS because that's the power that Congress gave the President many years ago.

Today, the Supreme Court, in a 7-2 decision, reinstated President Trump's travel ban, overturning the 9th Circuit's decision.

AG Chin will argue that we have good people coming from: Syria, Chad, Iran, Libya, Somalia and Yemen

Nice.

IMO the States have been stomping all over the federal jurisdiction for a long time.  I think the new makeup of the surpreme court is going to swing this back in the other direction on many issues.

Both are assholes.
After seeing the vote was 7-2, why did I just  know it was Ginsburg and Sotomayer before reading the article?

AG Chin grants all rights to illegals except the right to buy firearms. Why so selective?

I think this legal fight is dumb in that it is within his powers to do so but I also think it was a dumb ban to begin with. It wasn't necessary and the objective could have been obtained through non sensational means. Not wise on Trump's part.

If I'm not mistaken it's a continuation of the exact same ban Obama had in place so not sure what's the big deal all of a sudden

It wasn't the same as Obama's ban. It shared a few of the countries though.

Nope.  Obama never named the countries.  He referenced the section of law that states what criteria would be used to identify which countries would have travel suspended.

Trump actually included the names of the countries in the EO.

Quote
(B) Emergency termination

(i) In general

In the case of a program country in which an emergency occurs that the Attorney General, in consultation with the Secretary of State, determines threatens the law enforcement or security interests of the United States (including the interest in enforcement of the immigration laws of the United States), the Attorney General shall immediately terminate the designation of the country as a program country.

(ii) Definition

For purposes of clause (i), the term “emergency” means—

(I) the overthrow of a democratically elected government;

(II) war (including undeclared war, civil war, or other military activity) on the territory of the program country;

(III) a severe breakdown in law and order affecting a significant portion of the program country's territory;

(IV) a severe economic collapse in the program country; or

(V) any other extraordinary event in the program country that threatens the law enforcement or security interests of the United States (including the interest in enforcement of the immigration laws of the United States) and where the country's participation in the program could contribute to that threat.
