Will I be denied a permit?
« on: February 17, 2012, 01:55:42 PM »
Hi, new here so not sure if this is the right place. So yesteday I went to register for a permit and need to wait the 14 days or so however.. In december my sister, who lives in Cali came over here and we got into a bit of a fight (I know i know....) So she called the police, they came and gave me a talk blah blah. Thats all that happend, they said it would be reported because they showed up but that's it. Now according to the law a person must be convicted of a crime inorder to be denied a permit. So what do you guys think? Am I good or?

Thanks alot

From your story, it should be nothing. No charges were pressed, no conviction of a felony act, and no TRO. So sounds like you're fine.

And welcome to the boards!  :shaka:

Thanks kaneohe.
I hope so, I just feel like they are going to see it and while it's not a conviction it is still there. Well see!

"rswarrior's" advice is bad advice and not true.

You can be denied without ever having been arrested.

You can be served with a T.R.O. And are ineligible as long as you are bound by the order.

You can also get put in "the car" have your photo taken and printed at the station and still able to purchase firearms.
Getting arrested for a crime doesn't necessarily prohibit you from firearms ownership.

Your number one Option for Personal Security is a lifelong commitment to avoidance, deterrence, and de-escalation.

Someday someone may kill you with your own gun, but they should have to beat you to death with it because it is empty.

"I went to register for a permit" =  "infringement"

"need to wait the 14 days or so" = "infringement"

"You can be denied without ever having been arrested." = "infringement"

Just sayin'.

Again.

I do believe that the radical and crazy notion that the Founders meant what they said, is gradually soaking through the judicial system.

Ok, a little lost as to what you mean 230rn. Like copywrite infringemnet..lol wat.

No but a little more info, When the police came my sister was being crazy( (no big deal here) and she kept saying she wanted to press charges but after awhile she said she did not want to. Now all the police did was talk to me, agree that my sister was crazy and that it's hard to not get into a fight with memebers of the fam. Never entered the car, no finger prints were done or photos. I just sat on the stairs and talked with them about what happend, and then went back inside. All I remember them saying is it will be recorded as a report because they had to show up. I did however have my finger prints taken when I was like 13 because I was blamed for pulling sprinklers out of the ground at a school......that should not matter though!

Keoni is right. You can have a criminal record and still own a gun. Disqualifiers are: Active TRO , any Felony conviction, and a domestic violence conviction. if your doctor says that you are psychologically unfit you can also be denied.

As kaneohegrown and others have said you are "good to go" since none of the above occurred in your case.  Simply talking to the police when they responded does not disqualify you.

Me:

Quote
"I went to register for a permit" =  "infringement"

"need to wait the 14 days or so" = "infringement"

"You can be denied without ever having been arrested." = "infringement"

What I'm saying is that these requirements or any pre-conviction or pre-committment  behavior being considered as grounds for denial are violations of  individual civil rights.

That is, to make it plain, they are "infringements" on your rights and violate  the highest law of the land.

Some folks are so used to these plain infringements and violations of their constitutional rights that they do not see the above instances as anything out of the ordinary and will allow the plain english language  of the constitution to be watered down to suit current fancy,  fiat, and fashion.

Sir, having to register for a permit is unconstitutional on its face.

And having to wait 14 days is unconstitutional on its face.

And being denied without having been properly adjudicated as incompetent or criminal is, also.  Note the word "properly," which is another issue.
