Arghhhhhhhh, Jury Duty Again!!!!
« on: August 23, 2017, 08:22:05 AM »
My wife has never received the jury questionaire. I just got the questionaire, again. Last time I got it they tapped me for a jury case and I was out of work for 3 days. First day I waited. Second day I got picked, third day I served.

Why me? I lived in CA for 50+ years and only got the questionaire twice. And they allowed me to get off for finanical hardship as at that time it was a hardship for me. I have lived on Oahu for 7 years and I have received the questionaire twice and I cannot get out from underneath the juror requirement. And I know once I return the questionaire, I will be picked shortly thereafter. Which is what occurred the last time.

Anyone else feel like they are being targeted or picked for jury duty more often than normal?

Federal employees seem to get "hit" more often.  People I work with get selected left and right.

I was selected maybe 5-6 years ago.  It was actually a fun experience.  It was a super short case.  Expected to be 2 days max.  First day was selection and we had the testimony completed by around 3 pm.  We deliberated for maybe an hour and then went home.  We were done by 11 am the next morning.  It was about a stolen vehicle.  They asked if anyone had their car stolen and I was the only one that said yes. I answered honestly that I could remain impartial.  I figured no way the defense keeps me around.  Well, I was wrong.  Haha.

One of my best friends is a former prosecutor and from what I was told, the prosecutor on this case was terrible, and he really was.  His case was pretty much "liar, liar, pants on fire".  Well, we convicted anyways, but mostly because of the her own testimony!

ETA: There were a couple English as second language ladies in my jury pool.  One had her number called.  She made the excuse that she couldn't really understand the language.  Well, I heard her speaking to someone in the pool room and her English was just fine!   :grrr:

I just got the questioner last week.  I've been summoned 2x in the past 3 years and each time I called (24hours prior), the case was settled.

If I have to go in, I'm going to wear a MAGA hat and a 2a shirt.

This last case I was on was about a guy who beat the shit out of his girlfriend. And she pressed charges against him. Then they arrested him and she dropped the charges. But they felt they had enough of a case to prosecute him any way because they still had her sworn testimony and brought her in as a witness. As a witness she swore she was coerced by the prosecutors to testify against him and that he didn't beat her.

I only had to serve once on a criminal case and it was interesting.  Look at it this way - if you're ever the guy that's being prosecuted, wouldn't you want to have jurors that are open-minded and willing to serve?  I think most jurors hate being there so the defendant is already starting off in the hole.

I've been called three times since I moved here. Once the case was settled before the selection process; the other two times, I served as a juror. While I admit that the selection process doesn't seem very random, and the timing is rarely convenient, it really irks me to hear people complain about jury duty, or to discuss strategies for not getting selected. And on a forum dedicated to the support of the US Constitution? My sympathy meter is at 0% and trying to go lower.

I had to call in for possible jury duty in June.  Case was settled, so no need to show up.  This was my third time being added to the "pool", but haven't served yet.

It's a much nicer system now.  The first time I was told to call every month from Jul to Dec.  The jury was already selected or not needed each time, so I was given a new date the next month to call back.  Six months of calling, and never told to come down to the courthouse.

I also received the Jury Service Questionnaire about a week ago last Friday.  Sent it back last week Monday.

The form said it's for 2018, so I assume it's FY 2018 --> Oct 2017 - Sep 2018.

A long time ago I had a spurt of receiving the questionnaire several times in a few years, but never had to go, although it once got close to the actual date. It's been maybe ten years now since I last got it. I might be blacklisted.

I got the questionnaire last week too.  I would like to be on a jury just to see what it's like.  Previously my cases were settled.

I'm 49 years old and have never been called. Apparently, the trick is to bring a book.

+1  If it is a criminal case, my answers to defense lawyer pool questioning will likely get me out of there fast.

Mentioning jury nullification will have prosecution booting you out of the pool.

Had to laugh when Honolulu sent me a jury notice, after living on the BI for years.  Recently wife got a notice, apparently for the Hilo court.  That should get her out of it.

as much as it sucks I go to jury duty.  Because if I was accused of a crime I'd want a peer on the jury, not just a bunch of unemployed people that could not figure out how to get out of jury duty.

Plus jury nullification.  If it is a crap law, especially a firearm law, I will call out that BS and refuse to punish someone for some idiot legislator's billionaire funded law.

Wow.
I didn't even know about jury nullification.
That a jury can declare a law unjust or unconstitutional and therefore basically acquit the otherwise guilty defendant on the grounds of a violation of an unjust law.

That's pretty Radical.

I gather they do not tell you what the trial is about before hand.  Probably to prevent jurors from picking and choosing trials that have personal interest for them.  No prejudge I suppose.

No way would they let me on the Bundy trial jury.

No they do not tell you until you are in the courtroom doing jury selection.

Unfortunately every time I go to jury duty I get thrown out because Im a physician.  I think the attorneys worry that I will influence the other jurors so they dismiss me.   Last case was someone busted for "allegedly"  selling meth.  The defense attorney asked me if I know how meth effects people and I said yes and they sent me home on the spot before the trial started.

But I keep going.  I hope to be called for some stupid firearm law that clearly is unconstitutional.  Like Hawaii requiring physician clearance for purchasing a firearm.   as a physician in Hawaii, I literally can call the police on any patient and have their firearm license revoked for any reason I see fit.  When I started working here I called the firearm enforcement division to see what my responsibilities were.  no due process.   Total BS.   The second amendment does not say anything about doctor clearance to own a firearm.

So use your power as a juror.  Same as the president gets to pardon someone.  we can decide if a law is unjust or unconstitutional and refuse to send someone to jail.   (just dont say jury nullification.  the judges and attorneys dont want anyone to know about that)
