Yep.  I'm surprised the nurse isn't facing charges of resisting arrest -- even though the arrest was unlawful.   :wtf:

I'd like to add... does it strike anyone but me that it's utterly preposterous that this cop who roughed up the nurse and illegally arrested her is allowed to walk around 24 hours a day open and/or concealed carrying a firearm (including of course after this "incident") while you and I, law-abiding citizens with no arrest record or mental health issues, etc. are not allowed to be outside our home or business with a firearm for self-defense without being deemed criminals? (Plus, I'd be willing to bet that wasn't the first time that cop "possibly went beyond the bounds of totally lawful action"...).

I saw the video (shorter version than described above) this morning.  Yeah, that was pretty bad.  Totally didn't need to do any of that, regardless of right or wrong.  It's not like the nurse was unruly or anything close.  She was totally calm up until the point where the guy put his hands on her.  That said, the detective is probably just simply an asshole.  Have them in all walks of life, professions, etc.  Some actually get away with worse because they do so behind the scenes (politicians. . . ).

That detective Payne  :rofl: that handcuffed her is a "trained phlebotomist".
You would think a big part of that training would include some basic law.
In the same way that laws are a significant portion of a pistol safety class here.

Case of the nurse and the blood sample made Entertainment Tonight tonight.
Of course they full blast sensationalized it.
But at least they did it in a way that made the cop look like the Monster Dick he was.
Good interview with the nurse. Hope she gets more than $30K.

Still not as classic as being read your Right to remain silent and not answer questions after being arrested for being silent and not answering questions.

In a typical CYA move, after 24 hours of viral (bad) publicity (there's no worse publicity that the reality of how cops actually behave when they can't successfully bully someone) about how their officers behave when a law-abiding person refuses to follow cop orders to break the law, the cops have now removed the officer from "active duty" to "paid administrative leave". How very big of them. The cops and the mayor have "apologized" and the cops claim they will "investigate". Amazing how a few million views can make corrupt cops publicly comment on their corruption, rather that remaining silent as they sweep it all under the rug. Now let's hope the nurse files suit and sues their asses (note she says other hospital employees have been harassed by the bully cops under similar conditions in the past).

Okay, one more, from today's news. Not as "stupid" as the original "arrested for remaining silent then read right to remain silent", but with far more devastating consequences for the victim of police "incompetence".

Interesting that a former cop witness was willing to contradict the absurd claim of the woman cop who shot the suicidal man in the back paralyzing him. It's also interesting to see that every once in a while the Ninth Circuit gets one right., though they probably dislike all cops (not just the "bad" ones) as much as they dislike the idea of armed civilians.

San Jose must pay $11.3 million to a mentally disturbed man who was shot in the back by a police officer while standing on his front lawn holding a knife, a federal appeals court ruled Tuesday.

Hung Lam, a Vietnamese immigrant in his mid-30s, survived the shooting but was left paralyzed and must use a wheelchair, said his lawyer, John Burris.

The officer, Dondi West, testified that Lam had first held the knife to his own throat but then began walking backward in her direction, still holding the knife and causing her to fear for her life when she shot him. But the Ninth U.S. Circuit Court of Appeals said the jury was entitled to believe another witness, a retired sheriff’s deputy, who said Lam made stabbing motions only toward himself and posed no threat to West.

“The jury’s verdict is supported by a (first-hand) witness’ testimony,” Judge N. Randy Smith said in the 3-0 ruling.
