To be honest, he is the one who broke the law in the first place. I'm not saying I agree with the law, nor am I going to martyr him for being honest for reporting it; it would've been more irresponsible and akin to criminal mentality if he didn't report it. We have to remember that he brought this upon himself. He didn't choose to get robbed, but he did choose to take his guns to the mall. I'll admit, albeit very rarely, I'm guity of doing the same thing. It's infringingly inconvenient to go all the way home, then go back to the supermarket just because you have the car and your wife called to ask you to pick up a carton of milk.

Having said that.....this bullshit law needs to be fixed, sugu. We should work together to point out how this law demonizes innocent people who simply needed to or wanted to make a stop somewhere along the way to or from their place of residence or sojourn.

There could never be criminal intent.  Even if you had a law that required you to report your guns being stolen, if they were stolen from a place you couldn't have it, the 5th amendment says that you can't self incriminate -- which would be exactly what this man would have done.  He had a constitutional guarantee to not have to report his gun stolen;  I certainly would never have.

So...  Once again Hawaii's BS gun laws punish a citizen for doing the 'right' thing when his firearms where stolen. Even though he could have been free and clear by not saying a word.  :wtf:

Another point to add. You don't have to be the registered owner of a firearm to fire or possess it. Guns can be lent out, for those that didn't know. Just read through the Hawaii Revised Statutes section 134. All responsible gun owners should be familiar with most of HRS 134. Know what you can and can not do and prevent yourself from being violated. 

Could be wrong, but, I don't believe you can lend a handgun for any amount of time.  Correct me if I'm wrong.

This all depends on our definition of "lend."  If lend means I can't let you touch the gun in my presence, then well we are screwed lol (we would have no way of teaching classes).  If it means you can't leave my sight my firearm, then we are good, because this is what we all do right now. Right now you are correct though, you can only lend out long guns.

Hypothetical question.  My SO is legal to handle firearms.  I go on vacation, there is a home invasion, my handgun is the easiest accessible firearm for defense,  she shoots intruder.   Probably never happened in hi before to case study.  I know yanal,  but, what do you think the repercussions would be?

I don't know how much this helps, but before Uncle Sam sent me away from Hawaii, I was worried about my guns rusting and I called someone in HPD about whether I can have a friend take care of them for me. She said that as long as my pistol didn't leave my house, it's cool. Your SO should be fine, I guess.

I have another related question. Is it possible to register a gun under a trust in Hawaii, like NFA firearms can where they're legal, so my hopefully-soon-to-be can take "my" handguns to the range if she wanted?

People who are married can get joint custody of weapons.  You and your spouse can have joint registration.  I wish they could do that for children of age.

oh my god if I had a $ everytime some idiot at HPD said something that is totally not legit lol. 

Technically, under the law, your SO could be prosecuted for possession of a unregistered firearm.  However, it would be so stupid and get smacked down so hard they would likely never even try to convict.  The choice of evils defense would be soooo strong and compelling, even in bleeding heart hawaii you would likely get off with no problem.

Defendant takes the stand:

"I Didn't want to get raped and murdered, I feared for my life and there was a criminal in my house"

I wonder if this applies to civil unions yet.  It's crap like this that makes me want to just put all my guns in a trust.

In Hawaii you can only legally transport a firearm to: HPD for registration/transfer of registration, from a retail establishment after purchase and then home or HPD for registration prior to home, to and from a retail establishment for servicing (gunsmithing) or to the range and back home.  The arrest was affected ecause the individual admitted to leaving the range and stopping at the mall.  He did not go directly home.  He was in violation of the letter of the law but I agree with Nihonjin in that it should only be one count, the shotgun and not three as the two handguns were never visually nor physically verified by the arresting officer to be at the locatin.
