Removed a Trespasser.... (Read 17750 times)

Removed a Trespasser....

Had to approach a trespasser the past weekend...

Long story short, we maintain a business property over the weekends. The property is located in a business district but has underground parking....Busy during weekdays, no one around during weekends....

Pulled into the parking structure on a Sunday with no other vehicles around. Noticed a "homeless" individual sleeping in one of the stalls. As we have the right to "maintain" the property this includes cleaning, removal of trash and trespassers, etc.... We have noticed a lot of used food containers, cig. butts., bottle caps, etc.
over the past weekends.

A. Had the wife pull to secure corner of the lot with easy exit. (if she/we needed a quick escape)
B. Instructed the wife to dail 91.....(hold and watch) Lock doors!
C. I approached the trespasser in a non-confrontational manner... (holding a full canister of pepper spray behind my back)
D. Stood half way blocked behind a concrete wall and annouced my arrival.
E. Trespasser awoke and said he had permission to be here... I said "NO, I am the care taker, no one gave you permission" "Because of continued trespassing you need to leave!" He gave an upset huff and began to pack his things... He had a medium pack with some camp gear.... He was upset but did not pursue....
F. Stood around the corner and watched him make his way along...

I beleive I handled the situation well and obviously it went well... He made his way and did not come back.

There is no doubt in my mind this kind of confrontation will be almost a common place as things go on...

I would appreciate any creative critique.... (I would have loved to legally ccw, but Hawaii dosen't allow...)  Besides a Mace brand pepper spray, I had a folding knife, and a tac light.

What would you do if he did became verbally aggresive?

What would you do if he became physically aggresive?

I ask HPD to do it for me.  The only suggestion I would make is to have your wife video it so if he does get violent with you, your actions are justified.

I didn't think it required HPD or MPD in this case, at the time.... good idea on the video just in case. :thumbsup:

MPD not necessary because things did not get violent/dangerous.  Unless you are a security guard, I'd say call MPD in the future.  You pay taxes and that's what they are there for.

If you bug MPD enough they'll probably show more presence and the bums will be dissuaded from camping out there.

You say that you're the care taker, that you maintain the property.  I'm inferring that means you aren't the owner.  However, the owner can give you permission to carry there.  Seems like a reasonable thing to ask.

That being said, I'd still side with the "call the police" votes.  Although you handled the situation in a very intelligent manner, you still engaged in a risky course of action when you had a choice not to.

True, the Robinson family here has there own security staff that pack heat at all times. Due to people trying to grow weed on there land. And I'm with KK, BUM FIGHTS!!! Lol

That's why I call HPD.  I don't have to deal with the hassle and you never know who might get apeshit out there.  And yes, I call them enough that I've gotten to know some of the officers that show up, and they don't seem to mind.  And yes, the bums seem to come around less often knowing that we'll call to have them removed as often as we see them outside my business.

^^^Since it's Maui and they are getting quite the rep for tazing people it would have made a pretty good real life demo of the tazer effectiveness.

All comments taken into consideration...

The reason I did engage the individual is for the fact the he was by himself and not in a group. He was "sleeping" at the time and non-confrontational.... (I do realize that can change in an instant).


The wife or I would have easily called MPD if needed, but at no point in the confrontation was it necessary...

Without being there, this could be off base, but it sounds a little overly confrontational at the start.   Even when I was being threatnted by guys serving, I tried to maintain that level of professionalism.   Instead of "NO" I might have said, "Sorry (sir, mam, brother etc.) its time to go - you don't have permission to be here, and you have to leave."  I try to keep the sir's, mams, or some sort of identifying word in there.  Anything further would just be "hey man, these are the rules I have to follow, I don't want have to call police to take care of this."

Not saying you did anything wrong, but it seems like your taking precautions for a felony stop ;p when its a homeless guy sleeping on the ground. I guess it's good and bad - it may have added a bit of extra tension to the situation.

I also don't lock the car until I know there is a threat or a problem (I may have to get in it, and I don't want the woman to forget to unlock it ^_^ ).

LoL.... Cant do it... tazers, batons, slap jacks, etc. are way illegal in Hawaii.... (trust me, tried and checked  :-\)

Thats why we sell Pepper Sprays, Kubotans, Personal Alarms, etc. that are legal for self defense use in Hawaii.. ;D :shaka:

Spray a bunch of pepper spray around the area and if they come back and rub the walls and face burrrrn baby burrrn.  No that's not PC I would never do that.  Just call the cops thats what their paid for right?

I work as a security officer and deal with the homeless every so often. I keep my distance when I approach and on my guard just in case. I've never had one that wasn't compliant, and some that had a passive aggressive attitude but in the end would move along. I always have a can of Fox spray in hand. That stuff is bad ass.
