M-1 carbine?
« on: April 28, 2018, 10:42:20 PM »
So an M-1 carbine is okay so long as all the mags are 10 round, because someone somewhere had a pistol version?
But AR-15 is okay with 30rd mags, even though a pistol version exists? I thought AR would be limited but think I see folks using 30s in video.

Both are considered the same, anything over 10 rounds is illegal.  However the law isn't enforced by LE.  Might get you kicked off Koko Head range though.

Standard M1 carbine mags are fine.  Standard capacity and drum mags are fine when used in rifles.  Feel free to use them at a range, but follow range rules.  Pistol versions of rifles and other pistols with magazines outside of the grip are illegal in Hawaii unless the mag is permanently attached to the receiver.

You can't own a semi-auto AR-15 pistol that accepts detachable magazines. That would be an illegal assault pistol as defined by HRS-134.

You can disable the semi-auto action or permanently affix the magazine to the pistol receiver, both of which cause the pistol to be legal in Hawaii and less capable than a factory AR-15 pistol.  A mag that can't be detached and a pistol that can't cycle as a semi-auto both reduce effective rates of fire.  A permanent mag also busts the very definition of what's prohibited.

I don't think the AR-15 pistol we can have falls into the same category as other semi-auto pistols with removable mags.  Basically, the restriction on AR-15 rifle mags is theoretically negated by the ban on assault pistols.  Technically, however, the law as written is not that specific.

Some gun shops in HI sell 30 rd AR mags to the public, and some limit them to LEO buyers only.  However, I've seen police officers in the checkout line watching people pay for 30 rd mags and didn't say a word.

I only take 10 rd mags to the range for my AR.  You can't load more than 5 rds anyway, so why use anything else?

Choose wisely.

HRS has 1 definition for "pistol" and another for "assault pistol". The 10 rd mag section states "pistol" and doesnt mention "assault pistol".

Interesting.  Never thought of it that way.  Though an assault pistol is both a pistol and assault pistol.  Like a square is a square and rectangle.
