Sens. Richard Blumenthal (D-CT), Sheldon Whitehouse (D-RI), and Mazie Hirono (D-HI) filed a lawsuit Monday challenging President Donald Trump’s appointment of acting Attorney General Matthew Whitaker, claiming the move was unconstitutional because the top Justice Department official was not confirmed by the Senate.

Filed in the U.S. District Court for the District of Columbia, the lawsuit is the latest effort by Democrats to challenging Whitaker’s appointment. The move comes after the Justice Department’s Office of Legal Counsel released a legal opinion defending the appointment. “As all three branches of government have long recognized, the President may designate an acting official to perform the duties of a vacant principal office, including a Cabinet office, even when the acting official has not been confirmed by the Senate,” the opinion stated.

The Dems in Congress are using any and all issues they can latch onto to resist and disrupt Trump's presidency and successes.  The more he succeeds, the worse for them.

Of course, every time the administration has to send lawyers into court and defend his actions, it costs the taxpayers thousands and thousands in salaries and lost productivity that could be spent fixing real problems.

Waste of time on another nothing burger. . .

Acting roles are just that.  Temporary position until the position is filled permanently.  I admit that I didn't read the whole document with the allegation nor know the full requirements for designation of acting roles for positions that were recently vacated.  But it is my understanding that this happens all the time. 

Why hasn't Hirono commented on Avenatti?  Hmm. . .

She's trying really hard for a shot at the presidency.  I think she'll run in 2020.  Gabbards effort seems to have lost steam.

yup, there's a rule, you can have the position in an acting role for something like 230 days
and as long as you are up for nomination, you can keep the role as long as you are under consideration

At my lowly level, we typically rotate covering vacated positions on somewhere around 30-180 days blocks.  That is until the position is filled through the normal process.  The show must go on and need to have someone fill the role.  Just wasn't sure what the rules are for higher levels, but assumed they weren't that different.

Opinion piece in the New York Times opposing the action as illegal penned right after the temporary assignment of Whitaker as "acting" AG  was co-authored by none other than the former acting solicitor general himself, the Washington, D.C. hired gun paid by the state of Hawaii to further suppress our rights in Young v Hawaii, Neal Katyal. He and Hirono are two peas in a pod.

I just viewed it as more an attempt to grab headlines regardless.  I don't realistically see her going anywhere higher.  But then again, I had hoped the recent senate race was at least closer so show her that folks are waking up to her BS.  But guess not.   :(

Fun fact: When Loretta Lynch retired, the Trump administration asked Deputy USAG Sally Yates to fill the position as Acting US Attorney General until a replacement could be confirmed by the Senate.

Where were Hirono and the others when Trump did THE EXACT SAME THING almost 2 years ago?

Yates only filled the position for 10 days, when she told the DOJ to not enforce Trump's immigration executive order.

Guess what? Yates was immediately dismissed by the Trump administration via hand-delivered letter, and replaced with Dana Boente, the United States Attorney for the Eastern District of Virginia.

That's TWO Acting US Attorney Generals Trump appointed with NO Senate Confirmation.

Now, all of a sudden, the Democrats are angry because Trump fired A LIFE LONG REPUBLICAN as USAG, so now he can't name an acting USAG without Senate confirmation?

They forgot the law then (twice), and just remembered the law now?

I think it's more along the lines stated by Joe DiGenova (https://2ahawaii.com/index.php?topic=32616.msg290634#msg290634), they know that Whitaker might have the ability to actually clean house a bit and launch true investigations into the FBI/DOJ under Obama, at his command, and if such were to happen, they would, in DiGenova's words on the radio as per FCC requirements, "go to the bathroom in their pants".  :rofl:
