I have tried to find any updated reference to the "hoarding" statues, particularily Ch. 128, where the initial citation appeared to originate. I haven't had any luck....but that's partially because I have been a little busy and haven't had a lot of time lately.
But, I do think the issues Terry (230RN) brings up are valid, and while not generally inclined to jump onto conspiracy theories, I do think that such laws, whether intentional or not, create a possibility that the .gov COULD use to go after "preppers" of all types.
What to do? Watch the legislature....which is difficult. I geneally consider myself pretty well informed and try to stay updated with these types of issues, but I missed the recent concurrent resolution that asked the Feds to, among other things, repeal the Second Amendment. CISPA and other encroachments are insideously transforming our expansive personal freedoms into a mockery of what our Founding Fathers envisioned. The "Terry" frisk is a clear example of how our personal rights can be slowly diminished....initially the case alleged that an officer could not search anyone without probably cause, then it was only if the officer thought that there had been, or was about to be a crime AND thought the subject COULD be armed. Now, they just routinely search using the "everybody is considered armed" argument.
Executive Orders (EOs) are another issue....some have argued they are overreaching Presidential Authority and circumventing the controls intended by our governmental framework. In otherwords, our Founding Fathers were well aware that unchallenged authority would inevitably lead to problems, hence the separation, and associated checks and balances, on the branches of the government. I personally think the Founding Fathers would be agast at the idea that a President can, with a stoke of his pen alone, bypassing the clear mandate that all laws are created in Congress, implement policy and procedures that have the force of law.
For now I think the chances of the .gov coming after "preppers" is pretty remote....but who knows what minor issue may cause them to suddenly reverse course and target them.........I hate to invoke the "slipperly slope" or the "camel's nose under the tent" analogy, but they do seem somewhat relevant to this issue.
