Are pistol brace legal in Hawaii?
« on: April 03, 2019, 05:05:25 PM »
I just came across a Youtube video on Glock pistol brace. Please refer to the link below to the vid and manufacturer's website.
My question is, is it legal to own in Hawaii?

Hawaii would call that a SBR, illegal.

If I have the info correct, it's all in the design.

If the designer intends for it to be shouldered, then it's illegal here.

If it's designed to be cheek-welded or strapped to a forearm, it's legal.

IANAL.

The ATF issued an opinion on the Sig Brace, saying the legality was based on the operator's usage. They then "clarified" that opinion to say it's based on the functional design, not based on how it's used.

https://www.sigsauer.com/press-releases/atf-clarifies-ruling-pistol-stabilizing-braces/

Quote
“With respect to stabilizing braces, ATF has concluded that attaching the brace to a handgun as a
forearm brace does not ‘make’ a short-barreled firearm because … it is not intended to be and
cannot comfortably be fired from the shoulder.” The letter continues: “Therefore, an NFA firearm
has not necessarily been made when the device is not re-configured for use as a shoulder stock
— even if the attached firearm happens to be fired from the shoulder.”
The reasonable man adapts himself to the world;
the unreasonable one persists in trying to adapt the world to himself.
Therefore, all progress depends on the unreasonable man.

Based on Flapp_Jackson's statement, this brace would be legal in Hawaii.
Any input from others would be appreciated.

If it's fun or useful it's probably illegal
If the news was lying to me I would have heard about it on the news.

If it's legal per the ATF, then it's probably legal here.  HOWEVER, the way "they" work around here, they might try to charge you with something, and you'd have to sue to get your rights and property back..  IMHO

IE "shockwave firearm" should be, by the law, legal here, but they interpret the law as they are SBS, even though others have built their own "not a shotgun" and have registered them

100% legal on a rifle

100% legal on a pistol...but you have to have a non-detachable magazine or some other feature that keeps it out of the "assault pistol" category....
I'd rather have a bottle in front of me, than a frontal lobotomy.

Most gun guys don't get it.  Cops know that they can run you through "the system"
it costs you money and costs them nothing, in fact they make money EFFing with
you eg Young v. Hawaii.
I don't even spend my time talking against gun control with the elected critters,
I spend my time making sure my local and state government employees ( except firemen)
aren't paid Shiite.  Firemen save lives, all other local and state government employees
are in the business of destroying lives.

I think you have to be careful about rifle installation, as to not reduce the length of the rifle below 26"   Buddy of mine has a mini uzi carbine, the barrel has to be 19" (IIRC), because the stock is so short.
