Is it legal for a family member to ship a build kit from out of state? (Read 4417 times)

Hello everyone,

This is my first post on this forum, so if it's already been answered I appologize.  I did try to search, but I havent been able to find it. Thanks in advance.

 I have a complete build kit that i would like shipped from out of state. It would be sent by a family member, and I'm having trouble convincing them that it's legal to send.  Does anyone have a handy link that shows what components can be sent to Hawaii without being an FFL?

 I tried looking through the laws, and got lost rather quickly (intentionally written that way I'm sure).  I don't think they want us to easily be able to determine what is legal and what isn't so most people will just play it safe and not send things.  Of course, I wouldn't ask them to send a lower reciever.  Thanks again!  I'm looking forward to this quarantine ending and being able to get to the range!

you can send a lower parts kit no problem
if you own the lower already, they can mail it to you
if not, it has to go to an ffl

Welcome to the forum!   :thumbsup:

If there is no lower receiver, then there's no problem legally.  Just don't include anything that's on the ATF's NFA list such as suppressors or full-auto sears (if you need someone to hold those for you, PM me  :rofl: :thumbsup:).

If the receiver (or any firearm) that you already own needs to be shipped here to you, then that's legal.  They need to follow all the ATF and shippers' regulations.  Once you get it, you have 5 days to register as an "out-of-state firearm".  No need to get a permit to acquire, since no transfer is occurring.

If you can order an item online and have it shipped to you here directly, then anyone can mail it to you from any state.

We do have restrictions on magazines and bump stocks.  Again, if a retailer won't ship it here, then don't have anyone else do it.

That's not a 100% guaranteed method of determining what's legal, but it's pretty close.  Some sellers are more strict or ill-informed than others, so they do make mistakes in their policies.

Rule of thumb: if there is NO LAW stipulating something is illegal, then it's legal to own and have shipped to you.  There's no all-inclusive list saying what's legal to ship here. 

You can always ask on here if you have any questions about specific items. 

Or you can ask HPD, but don't be surprised if half the "negative" replies you get from them turn out to be wrong.   :wacko:

I had Lasik years ago.  Still hoping I avoid the whole cataract problem. 

Had a coworker get Lasik right after I did, and he was pissed when the surgery didn't result in 20/20 vision.  After a couple of adjustments, they discovered he developed cataracts since his initial Lasik exam.

Easiest way to describe. If it has a serial number ship it to an ffl. Everything else ship it to your house 🙃

That means UPS or FedEx. Both of which have become very anti-gun for private shipping. Not to mention expensive as they must go overnight and adult signature required.

For pistols only,
Disassemble and ship as "precision machined parts" in two separate boxes.
UPS and Fed Ex have no problems with that.
Observe all laws of course.

I find that if someone is really uncomfortable with doing firearm related stuff, I don't put them on the spot or force it by showing them what the law states.

When Hawaii was trying to ban semi auto firearms in 2018, I was going to ship my AR to my secondary residence in NV.  I had the homeowner check with his wife 1st to see if it was OK to keep a secured AR in the home with no mags or ammo.  I told him what NV laws are (no registration required) and he believed me, didn't ask for proof.  I also told him that I will not hold him liable if it gets damaged or stolen.  Also had him confirm he and his wife are not felons, under indictment, consume pakalolo, or have any TRO's.  Got the green light, but luckily, I didn't have to ship it up there.
