FFL to get my gun out of HPD

Long story short, HPD has my gun and they wouldn't release it back to me because an idiot Dr. from Straub wouldn't sign off, like so many other doctors that work for Straub or Kaiser.   I recently moved to Texas and it bothers me that my gun that I paid for and belongs to me is being kept by HPD for absolutely no reason.  Best case scenario, I would like to find a Hawaii FFL to get the gun out and ship it to me or my wife in Texas, but at this point I'd live with an FFL getting the gun out of HPD and transferring it to a friend on Oahu.  I have all the paperwork, and I've confirmed that HPD still has it. Is there someone on island willing to help me out?  If so thanks.  I'll give you $200 if you can get it out to me or my wife in TX.

Man that sucks. Does the paper work go to random docs in the system?  That have no personal relationship with their patients? I'm fortunate that even though I have Kaiser my doc doesn't work in a Kaiser clinic and he's been my doc since I was out of pediatrics (over 20yrs)

You should contact a Hawaii FFL for advice.  The process is complicated, and more so because you are in another state now.  That means an FFL on your end will have to be involved.

I'm sure HPD handles transfers to FFLs all the time when someone is no longer eligible to own confiscated firearms.  Find an FFL who knows the details of that process.

You're better off paying a professional to help you than someone you never met on a gun forum, IMHO.

That's what I was asking, if someone could recommend an FFL if they've ever had to go through a similar situation. Not just a someone on a forum.

I'd wager any big retail FFL can help.  They should all be very familiar with the laws, the paperwork needed, and have a working relationship with HPD.

Those that come to my mind:
OGC
Young Guns
SEC
Windward Gun Shop

$200 is probably more than the FFL fees and shipping should cost. 

Since your situation involves more work than the standard retail transfer from out-of-state, I would not plan to pay a small $25-$40 FFL fee.  I'd want to at least cover their manpower cost.

I am envisioning a scenario where someone had to turn in a firearm for disqualification (for any reason).  In that case, I would think that the person who had to turn it in would have to claim.  Or I guess you just had to document transfer of ownership. 

The reason I am wondering is I almost had to go through something similar when my dad passed and he left the firearms to me.  My sister didn't want them.  I almost had to turn the firearms in while I got the documentation ironed out that my sister didn't want the firearms.

I get that it's easier for the FFL to transfer the firearm.  What I was asking if the FFL can even claim the property from HPD, or what was needed in order to do so.  I was more thinking along the lines of if someone had to turn in a firearm because of a TRO.  That I wouldn't think that an FFL can just show up and claim another person's firearm.

What does HPD require from you when you say you bought another private seller's gun?  Not even a bill of sale.  Just the specs on the gun and the seller's name.  If it doesn't come back as reported stolen, do they even bother to call the owner? All the owner has to do is sign the permit.  I'm sure the HPD Firearms officers are adept at spotting forged signatures on onion skin carbon copies.

The only additional factor here is that HPD has custody.  For them to release the guns to a new owner, I would think a bill of sale, possibly notarized, would suffice.

I remember reading once that a court order was needed, but I think that was in the specific instance of the person needing to expunge a felony from their record.

Power of Attorney would be overkill.  It would allow the "buyer" to act on the owner's behalf in all aspects, including signing papers for him.  That latitude would allow him to sell the gun to another party without the owner's consent.  I don't think I'd be comfortable giving POA to anyone not a close relative.

I was thinking something that shows transfer of ownership. For me, they said needed a notarized letter from my sister that she didn’t want the guns. That was because my dad’s will didn’t specify. However, that was the person at the window at the time’s direction. Not sure what is truly needed. I almost had to turn in a few of the guns because the registration didn’t show up. They were able to find the records eventually. Apparently some older records hadn’t been digitized. So I was just happy that I didn’t have to turn in a couple of classic revolvers.
