Yup this is stupid and frivolous lawsuit.  Hope they have to pay Cabela's attorney fees.

Apparently, the court disagrees with you.  If it's already allowed to be heard on the merits, by definition it's not frivolous and can therefore not be grounds for claiming attorney's fees.

we are in for more of this over the next 4+ years unless a few of the cases make it to scotus

If I’m not mistaken, in Hawaii, you can file a motion for attorneys fees and costs if you prevail at trial.
