SL's brother hits a couple of people in the group.............now I am noting how you didn't say SL's brother who at this time with fear for his brother's life/maiming/serious injury/rape/and or sodomy attempted to stop the group.............note that these guys could have ran into a store front at which point most likely this situation would have stopped.
you see a bunch of guys chasing your bro and swinging at him are you going to just stand by? he was running to a store front where his brother was but didn't make it there, so his bro came to him instead.
Again SL's brother willingly participated in the situation and caused it to escalate even further. One should also note that the brother did not yell out to others in the area to call police.
defending your brother from a beat down is escalation? 10 to 1? what do you thing the group was doing, chasing after him to make a citizens arrest? come on man.
5. This being said the group of people also contributed to the situation, but obviously they are the one's who called the police.
obviously? i'm starting to think you are more interested in proving me wrong. there were several other drivers who witnessed it (and the cops refused to take their statements) but I guess it's possible while they were in a running fist fight someone managed to pull our their phone and had 911 on speed dial. Unless you have the phone records it doesn't seem that obvious to me.
6. Lawyer obviously doesn't know the ungoldly crap that a CO will give his guys if his guys screw up, nor it seems do you.
The whole point is that they deserve some ungodly crap for their behavior, especially the part where they threatened to come back and kill people. I really hope this makes it to the attention of their superior, but somehow I doubt it will.
Item# 1 & 2 we are 100% in agreement.
Item# 3 - We disagree............big time. You are missing the point. This is where your friend's kid or anyone else in the vehicle should have called the Police. Everything up to this point can be forgiven, but I'd wager there were some stupid things said on both parts. Instead SL got out and assaulted people, then ran away. The fact remains that your friend's kid assaulted people and escalated the situation. He is rightly arrested.
The reasoning that he got out to draw the crowd away is stupid and I can't believe anyone is buying that story. He got out to fight, plain and simple. If I was truly afraid for my life...........people are getting 3,000# of car on top of them. If you've taken any type of basic handgun safety course they would have covered justifiable use of deadly force. One of these is disparity of force..............men on women, multiple males on smaller numbers of males, etc. What SL did is knowingly put himself in this situation by exiting his vehicle. Nothing about the vehicle getting rocked, hit, etc. simply he got called out and he left the vehicle.
Item# 4 - I thought you said the kid was quick on his feet? How come he got run down then? And why did he not continue into the store?
The brother, after the initial encounter, did he grab his brother and run into the store? Again no, right?
Item# 5 - That's right obviously not your friend's kid, his brother, or their family called. I notice not once did you mention anyone calling police. I would argue that they were not in fear of their life. If they did, then there would be communication with the 911 Operator and between the Operator and Police.
My suggestion to you is to have your friend get the names of the persons involved from the Police report. Take the report and go to the CO's for the men. Raise hell. I guarantee you that if these guys were US forces they would catch crap.
