Oppose this because to get 1, the chief "may" issue a permit. Which means u cannot buy 1 on amazon as well. Then add in the waiting line, just like to get a permit to acquire.

Support SB462 instead.

What this bill does is treat an electric projectile gun exactly as a handgun for FFLs selling them, purchases, permitting, registration, and posession.

Some rough notes on what's in the bill
-   Must have license to sell or transfer at designated place of business

-   Unlawful to receive a EG from another unlicensed entity

-   Permit to acquire like handgun
o   Attend training class, like a handgun class for EG
o   Serial number engraved if not present

-   RAPBACK

-   Registration

-   21 years or over

-   Only registered owner can possess EG

-   Same possession prohibitions as handguns

-   Firearm storage laws

-   Retailers apply for a State FFL
o   Apply for license
o   Employees complete EG training every 3 years
o   Engrave serial numbers if not present
o   Keep records for 10 years
o   Retailers brief buyers on EG ownership

Appears to be the same as last year's bill, hb2292, so you can use the same testimony.

HB891 (BAD) Electric Gun bill is up for a committee hearing and we need your help with opposition testimony again.  This bill repeals Hawaii's current ban on Electric Projectile Guns (EPG) and replaces it with a long list of requirements such as permits to acquire, registration, RAPBACK, ban on loaning, etc.   The State is basically treating an EPGs exactly the same as handguns.

In nearly all other States, you are able to purchase a Taser at the local department store or through Amazon.com and have it mailed to your house AND THAT'S IT.  Talk about red tape.  Not to mention even longer waits for an appointment at HPD!  Stores in Hawaii might not even bother to sell them due to the long list of requirements they have to go through.

OPPOSE HB891 due to the overly burdensome restrictions but supporting a clean repeal of the electric gun ban as worded in SB462 which has no extra requirements.  Or wait for us to win our lawsuit, Roberts vs Ballard, later this year to overturn the ban on electric guns.

Our Hawaii legislators, always trying to screw us over.  Like CCW, they want to "allow" tasers, but in reality really want to make a de facto ban on it.

Update:

AG supports the bill cause they want to regulate.

HPD doesn't support it because Nilsen mentioned they're already at max processing and adding tasers would over whelm the system

Todd was asked if  someone could change the output of a taser to make it more deadly.

Rep Sharon Har asked the Deputy AG if heavy regulation would be the same as a ban.  Which would fall under Cayetano vs. MA and Roberts vs. Ballard.

I admit I was wrong in my testimony when I asked (rhetorically) if they would unanimously pass the preposterous burdensome illegal unconstitutional infringement of the right to keep and
bear arms, as written ("shall not be infringed") in the U.S. Constitution and the Hawaii state constitution.

Who could have guessed? It only passed 12 to 1... not unanimously (Kong only "no").

Does anyone besides me despise these motherfucking authoritarian fascists?

Why don't they get it over with and just require a self defense permit for everyone.  If you don't have the permit, you can't defend against any threat with or without a weapon.

Save a lot of bs making a law for every weapon.

The taser bill has gone through a lot of changes.

In 2019, the AG introduced their bill, due to the Roberts lawsuit, which just required licensing by stores to sell them and minor stuff like storage but it went nowhere.  Takayama had a hearing for a different bill which repealed the ban with no other requirements and it was deferred.  HPD Maj complained that registration and training was needed.

In 2020, The same AG bill was introduced.  The AG complained that it did not have permitting and registration requirements even though they're the ones that submitted the bill?  HPD wanted permitting again.  So Takayama added permitting and registration to the bill.  It went almost all the way up to get approved, but there was some sort of disagreement so the bill died.

For todays hearing, the AG submitted the bill with all the changes, to include permitting and registration.  The Honolulu Prosecuting Attorney, Alm, supports the bill.  Wonder what Megan Kau would've done.  HPD Maj Nilsen now opposes the bill that he supported before.  The first time we've agreed to something.  Opposed due to stresses on the current firearms permitting and registration system.
