I'm not sure, just what I was told.  I know HPD also testified they needed more time to get the proper forms ready for sellers.

Also IDK if someone could tase someone else in a training scenario. I don't remember if can or no can.  But I do know as written, if a trainer uses a TENS unit on someone else, that would be illegal.

     §134-B  Restrictions on use, sale, offer for sale, distribution, and transfer of electric guns and cartridges.  (a)  Beginning January 1, 2022, it shall be unlawful for any person to knowingly or recklessly use an electric gun for any purpose except:
     (1)  Self-defense;

     (2)  Defense of another person; or

     (3)  Protection of property of the person or of another person.”

As for needing a license for a private sale of a stun gun, I don't interpret the law that way.

What 134-C states is:

either at wholesale or retail, shall annually file an application for a license to do so with the county in which the
person desires to conduct business or within the county to which the person intends the electric guns or cartridges to be sold,
offered for sale, distributed, or otherwise transferred using forms prescribed by the county

The clause "either at wholesale or retail" is a giant flag to me that the licenses are intended for businesses, not private sales.  No private seller has a "wholesale or retail" price structure.

Every paragraph of the licensing portion is written in a way that applies to businesses and their employees.  There is no mention at all of private sales.

The paragraph that drives this interpretation home for me is §134-B(c):

(c) It shall be unlawful for a licensee or employee of a licensee to knowingly sell, offer to sell, distribute, or
otherwise transfer an electric gun or cartridge at a place other than the licensee’s designated place of business.

That place of business is included on the license application.  So, how can they limit you to a designated place of business if you aren't actually engaging in sales as a business?

I think "license" and "permit" are not synonymous.  Licenses are for businesses, and permits are for everyone else.

That's my interpretation.  I'm not a lawyer.  Seek advise from someone who knows the answers before taking my interpretation as "the law."

It's official. Effective January 1, 2022, tasers will be legal for purchase for regular citizens.

However, it appears you will not be able to legally carry one on your person in public. At least ownership is a good start.

Tasers are extremely effective in stopping someone, BUT, I can't see spending several hundred dollars on a very short range single shot weapon if I can only use it at home. In that case I would rather use my Glock or Rottweilers.  J Hara Store on the BI sells bear spray, which is another highly effective deterrent with 30 ft range.

That's a bunch of hogwash.  Tasers are not a deadly weapon.  I carry a pocket knife and that's arguably more deadly.

They also have non projectile versions.  I plan to get one of those.

The question is does the taser fall under HRS134-51 "deadly or dangerous weapon".  If it does, then that means 1 can only open carry a taser.  Thoughts?

Our fav senator thinks it does. But the AG's testimony is that it doesn't.  Nothing in writing from the AG, just the verbal testimony.

10 years if it’s a two shot taser (semi-automatic) ?

Carrying ammo falls more under the "places to keep" law.  Ammo and guns are treated alike. So if you carry any ammo on you, then you need a OC/CCW permit.  Same goes with buying ammo, cannot buy from LGS and then go to starbucks after.

Oh shit. I cudda gone jail. I wen visit my friend an he wen ask me if I lik one box 12 gauge and 1 box 9MM since he no mo dat kine gun any mo.  I wen put um on da floor of my kar behind da front seat an waz driving around wit um fo 4 days. Gud ting I wen take um out.
