Article said they found the suspect using DNA.

But he was released and is now out there, potentially a danger to people.

I wonder why he was released.  Bail reform?  Non violent crime?  Crowded courtrooms?

Or a stupid, broken, justice system?

Any comment, State lawmakers?  How about you, Scott Matayoshi?

The said if she was already dead then it’s just a misdemeanor of “disturbing a corpse”

Now days you can commit any crime and as long as it is a M and not a F, you are free to go.
It is the “ new normal “.  Just don’t get caught with even one round of any ammo in your pocket.
Then you might spend the night in jail.

If you get busted on a Friday, you spend the weekend in Jail.
BI is third world. Judges don't work on weekends.
IIRC only a judge can set your bail on any alleged criminal
activities.

Its possible they didn't have enough information to prove the crime at that point.

What else would they need?  I'm thinking the DNA samples were from semen samples from the sexual assault.

And there was surveillance also.

I know a public defender. DNA like samples are expensive to run test on. So that cost for a dead body has little justidication on the budget, IMO.

The show CSI made it easier for pub defenders to get their clients off cause everyone ask for DNA and knows about it and the state is too cheap to run them for every case.

Sounds like that's a moot point and irrelevant to this case:

"Cassie is upset the suspect was released, especially since she said police told her they found him using DNA."

Obviously, the test was already run on samples from the crime scene, and the suspect was identified from a DNA database.  I have a sneaky suspicion he's in the system due to previous sex crimes.

If the Cops can't determine whether the assault was pre- or post-mortem, maybe looking at his previous arrests would indicate whether he's assaulted living victims before.  If so, it's unlikely he just happened to stumble upon a recently deceased individual and decided to take advantage of someone/something who couldn't fight back.

Either way, the guy is sick, and the evidence sounds convincing.

I may be missing some detail of the case here but surveillance alone may not be able to prove the sex assault. The DNA could prove who had sex with her.

The fact this woman died means she is unable to make a statement as to whether the sex was consensual or not. Now the video might look to be sex assault but you would still need a statement from the victim. This is why that HPD sergeant was able to get away with fighting with his girlfriend on video. Clearly he was hitting her but her statement was that they were sparring and that she did not suffer any injury which meant they couldn't prove the crime in court.

I'm also thinking that nobody in the justice system wants to take it to court because the woman was just a regular everyday person and the perp was just a low-life rubbish sex nut.  This is just my opinion.

You hear about our leaders complaining about crap like crowded court rooms and jails and makes people think the courts are only for high profile cases like the all important Amber Heard/Johnny Depp defamation suit going on.  Heaven knows we need justice for this terrible tragedy. ::)

I feel for the poor daughter and family of this woman who died. Meanwhile who knows what that sick sex maniac is up to.

Prosecuting office said because the investigation is still active they will decline comment.  I just hope this doesn't get swept under the rug.

Yeah exactly. The daughter went to the media because she was so angry when the cops and prosecutors told her “Well, these things happen.”

They just want to keep it out of the headlines so it doesn’t mess up their precious statistics. Citizens might start wondering why we are paying taxes for a bunch of corrupt lawyers and overpaid security guards to pretend like they are serving and protecting us.

I find that the public often reacts based on how things seem on the surface rather than the nuances of the justice system. Sometimes cops or prosecutors or judges do fail us but most of the timeI think people don't understand the complexities of the justice system. Hopefully we will get some sort of an answer, or at least the victim's daughter gets an answer
