U.S. Supreme Court orders lower courts
to reconsider gun law challenges

WASHINGTON, June 30 (Reuters) - On the heels of last week's landmark ruling expanding
individual gun rights, the U.S. Supreme Court on Thursday threw out several lower court
rulings that backed gun restrictions including bans on assault-style rifles in Maryland
and large-capacity ammunition magazines in New Jersey and California.


The actions by the justices sent these cases back to lower courts to reconsider in light of their
June 23 ruling that declared for the first time a constitutional right to carry a handgun in public
for self defense.

Predictably, all those firearm cases decided under "intermediate scrutiny" will now have to be reviewed, as the SCOTUS just ruled any judicial ruling using such scrutiny is a violation of the Constitution.  Rights are not to be restricted based on what the government thinks furthers their interests, like the ambiguous "public safety" caveat used over and over.

If "intermediate scrutiny" used to analyze and rule for gun restrictions is removed from the cases, judges and states will have to come up with another basis to keep the restrictions -- and this time adhere to the Constitution.
