So-Called 'Assault Weapon' Ban Is Unconstitutional

Quote
While they are very commonly owned, semiautomatic rifles like the AR-15
are rarely used to commit violent crimes. In fact, according to the Federal
Bureau of Investigation, only around three percent of firearm homicides
were committed with rifles of any type in 2018. The data show that handguns
are far more likely to be used in crimes, including mass shootings. If you
examine the database of all mass shootings maintained by Mother Jones
dating back to the 1980s, handguns are used more frequently and are
responsible for more deaths than are AR-15-style rifles.

Furthermore, a ban on "assault rifles" simply fails to have the big impact
that its supporters attribute to it. According to national crime data, violent
crime peaked in the early 1990s. The "assault weapons" ban was enacted
in 1994 and expired 10 years later—a decade during which violent crime
significantly decreased. But violent crime has continued to steadily drop
even since the ban expired, all while Americans have continued to purchase
more and more firearms. A 2018 study by the RAND Corporation looked at
all available research on gun violence and found that "available evidence is
inconclusive for the effect of assault weapon bans on total homicides and
firearm homicides."

He also goes into the Heller decision which says firearms "in common use" are protected by the Constitution.  The AR-15 is probably the most legally-owned and legally-used semi-auto rifle in America.  Estimates indicate there are at least 20 million of these rifles in circulation in the US.  There are also 81.4M gun owners -- about 32% of the population.  So, it's possible about 20% or more of the gun owners own an AR-15, AK-47, or both.

That sounds like "common use" no matter what your views on the topic are.  We're talking about numbers in the MILLIONS.

Those numbers, and the fact people have been conditioned to fear these scary-looking rifles, are why they are being targeted.  Ban the most common rifles in private hands, and you eliminate the largest number of guns in one fell swoop.

Bans only keep those guns out of the hands of law-abiding citizens.  Anyone who wants one can find it.

Don't believe that?  How's that war on drugs working out?  Simply passing laws won't stop the existence of contraband.

This renewed call for an Assault Weapons Ban is guaranteed to have an impact based on history -- demand for these guns will again skyrocket, producing the exact opposite of the results the ban is supposed to achieve.

According to Hirono, AR15's not included in 2a. . .  ::)

Coming from Rep in RI.  When I started reading, it smelled like stuff CA tried and had implemented.

This is what we call using emotion and not logic to ban something. The guys at the top however are using logic because they are relying on your everyday joe's emotion to cause politicians to support this. They know to start with the "assault rifle", then handguns are much easier because stats support a handgun ban over a rifle ban.

There's a broad gap between what a state can get away with, and what the US Congress can do.

Obama lamented he wasn't able to do more on gun control, especially when he had the emotional momentum after Sandy Hook.  Since the Dems controlled the House, the Senate and the WH, you have to ponder why he couldn't do what he said.

Now that the Dems again control the House, the Senate and the WH, why have they not already enacted stricter gun control laws?  Could it be that the laws they keep wanting to pass are being shot down in state by state as unconstitutional?  Or is it that even among the Democrats, they have a large number of 2A supporting voters to worry about having their butts kicked out of office?

Whatever the reason, they seem to rely on emotions and public anger/fear to push these gun control laws through.  If the laws could actually do what they claim -- reduce killing and violence -- there would be evidence in the strictest states.  Yet, the numbers are the opposite of what they predict will be the case.

The midterms promise to end the Dem majority in the Senate, and maybe the House -- just like the first midterms of Obama's admin.  They are going to push what they can while they can, whether it's unconstitutional or not.  Same as Obamacare --  unconstitutional as passed, changed after passage to avoid being struck down.
