Livingston Vs. Logan (Chief of HPD) / C&C of Honolulu Lawsuit
« on: December 14, 2022, 01:04:02 PM »
This was filed years ago about CCW. This is the "X-Ring" and NRA backed lawsuit.

The state is settling.  So far, both have agreed that the City & County will pay $14K, Chief Logan (formerly Ballard) will pay $14K.  And that the state cannot require an "exceptional circumstance".  This is really a symbolic victory because the AG already issued a statement on this that HPD is no longer using.

All that is needed is a judges signature.

Keep in mind Logans name is on this because he is the current Chief of HPD.  This was filed during Ballards reign.

They still haven’t issued any CCW permits, they arbitrarily made up a bunch of expensive hoops to jump through that is NOT written in the law, the chief still arbitrarily makes a decision on issuing permits. I’d say they still are not IAW the SCOTUS decision

What makes it harder is practically every politician in Hawaii does not support the SCOTUS decision.

And the LE in every county feels the same.

And Mainland USA doesn't give a rat's ass as to what happens in Hawaii.  Including the Reps and Senators that "we" send there. ::)

Nor, it seems does the NRA. They are conspicuous by their absence.
Maybe someone can tell me different. I am all ears.
If they are involved in helping us out, they are sure being discreet about it.
I have told their solicitors that I will keep my membership, but no more donations until I see some action here in the provinces ,
and would they please send that up the chain. :wtf:

I hope you're instead donating to HIFICO.  Mainland groups typically don't do anything for HI because we are such a small state.  What they don't realize is what happens in 1, can affect another. Look at OR's permit to acquire law that passed.  HI has the same thing and if any big mainland group helped fight this decades ago and won, then OR would not have been able to be in place as of 12/8/22.  I'll bet if CA had the $ to do this, they would do it as well. But they know it will cost more for police staffing (my speculation).

TBH, this was a poorly written lawsuit that got lucky at the Bruen decision.

But on a positive note, this is another lawsuit that HI has not won. I think they're like 0-6 now in settling.

The problem is any lawsuit will cost $ up front.  And once a CCW is issued, the lawsuit will be moot.  Logan knows this and is playing this hand.

The first group of people turned in their paper work last week Tuesday. So it's been 9 days and Logan said at least 14 days, but prob 30.

Mostly what CMO mentioned above.

I am not as involved as I used to be.  For NRA, they are aware, but in many cases they mentioned HI is lost cause and they focus elsewhere.  However, I do see quite a bit happening in the background to NRA via a number of dedicated folks, including/especially HIFICO.  Encourage all firearm enthusiasts in Hawaii support HIFICO and HRA.

NRA does a lot in the background, don't usually see what goes on unless you look and inquire.  They have been supporting most of the lawsuits across the nation that others have filed.  Amicus briefs and by supporting attorneys. They do most of the lobbying talking to legislators and funding campaigns in the last election.

They have been hit hard with declining revenue and their spending is inefficient.
