The ironic hypocrisy of the new law is that the tax payers already pay the legal costs of the State to defend against lawsuits.  The people filing suit are more than likely also taxpayers.

Making the plaintiffs pay the state would be double-dipping -- making the plaintiffs pay twice.

it's not as if the taxpayers get a refund whenever the State collects legal costs.
