Valid CCW holders bypass 2 week waiting period…

Learned something new today…handgun permit given on the spot, waived by ccw permit. According to hpd it is the law as of right now if you have your ccw permit card they have no choice.

I’m here right now, turned in my permit to acquire paperwork thinking I’d havto wait the 2 weeks, they asked me for my ccw permit, made copy, and stamped the permit to acquire an said here you go. I was shocked. But when I asked if it’s a new thing they said it’s in the law so they have no choice.

i found it in HRS 134-2(e):
Quote
(e)  The permit application form shall be signed by the applicant and
by the issuing authority.  One copy of the permit shall be retained by
the issuing authority as a permanent official record.  Except for sales
to dealers licensed under section 134-31, or dealers licensed by the
United States Department of Justice, or law enforcement officers, or
where a license is granted under section 134-9, or where any firearm
is registered pursuant to section 134-3(a), no permit shall be issued
to an applicant earlier than fourteen calendar days after the date of
the application
; provided that a permit shall be issued or the
application denied before the twentieth day from the date of application.

Sorry to burst the bubble, but HB984 removes that provision, and gives PD up to 40 days to issue a permit to acquire.

Buy guns while you can.  Training requirements might also change for permit to acquire.

Alan Beck was in town for a hearing similar to this. He was arguing that 14 days is an "undo burden" compared to a 20 min NICS check.  So lets see how this plays out.

Yukutake et.al vs. Lopez -state already settled on emailed PTA, open late on Wednesdays, and online reg, but violates online reg for non FFL. This is the last part of the lawsuit that they're taking to court.

Moving my state of legal residence to WA state.
no fuking permission needed to buy a pistol.
only a 10 day wait period on semi auto rifles.
I have enough of those at home in WA state.

I'll still reside here, I just won't vote. nor will I do Jury duty, or pay income taxes.

The 14 days isn't necessary with the instant background checks, but the 9th would justify it for the mental health checks to return from the doctor.  Right now the max time is 20 days, probably has to be justified if they need to investigate further.

Hb984 changes the max time to 40 days.  Probably needed for all the additional checks, checking with references, getting medical docs from all your doctors, etc.  So I don't think people will get permits within 14 days if hb984 passes.

Is this only being recognized by Honolulu PD? MPD says I need to wait 14 days.

Ask them to show you where that is located in the statute. 

Then show them that the statute says the licensee exception applies to all permits, not just handguns:

"... no permit shall be issued to an applicant earlier than fourteen calendar days after the date of the application;"

It doesn't differentiate between handguns and long guns when describing the exceptions for the waiting period.
