LOL!  Even after the US Supreme Court ruled that civil rights are individual rights, and that the state is not allowed to balance public safety against violation of civil rights, we still see the same arguments over and over.  There's no 'test" in the Constitution's Bill of Rights requiring a benefit to the community exist before permitting an individual to exercise that right.
