sensitive place's law is only for LTC permit holders

Yep.  I bet a lot of politicians who voted for it don't even know it.  Place to keep laws are for the non licensees.

Waiting to find out which one the guy was charged with.

Politicians that don't know what they're voting for........sigh :(

There is one more possibility that he could be charged with besides Place to keep and CCW in a sensitive place.

And that is illegal possession of a firearm.

Yep.  Those pukes made law-abiding citizens with LTC criminals by default.

I urge everyone here to work with your legislators to make a neighborhood sensitive place law that bans all burglaries, murder, theft, grafitti, homelessness, and public frisbee throwing.

I'm serious. No joke.

Charges in the bar shooting are:
murder 2nd
Terroristic threatening 1st
Place to keep
Carrying firearm in commission of separate felony

His prior criminal record doesn't make him a prohibited person, so it looks like the firearms are legally owned and doesn't have a CCW license.

"According to police, Dahlin punched Takushi while they were arguing at the bar before Takushi opened fire multiple times, killing Dahlin."

Sounds like he'll make a self defense plea.  Depends on who started and escalated the fight.

What happened with the Big Island case where the guy had all gun charges dropped because the judge ruled the charges are unconstitutional? Might this precedent be used here? Supposing the self defense is justified?

I knew the victim. He wasn’t the type of guy who would haul off and punch someone unless they were really asking for it.

We can’t carry on like we did before. Too many crazies running around.
Stop blaming lazy people. We didn’t do anything.

It seems like it's turning out pretty bad for the 2a community.  More fuel for the asshats pushing the anti-gun agenda.

No CCW and he still brings a gun into that place.  This sensitive bill sucks and is full of shit but it is the law.

These cases prove that the laws don’t work, so now they double down and try to gaslight us.

If you are at an establishment where guns might be present then you will behave differently than you would with the illusion of safety.
Stop blaming lazy people. We didn’t do anything.

It can be brought up as a defense and has some sway, but is not binding to other judges.

Time to up the ante and strengthen this "sensitive places" law!  :shaka: We should petition our all-knowing legislators and rewrite it to say "SUPER Sensitive places" to make us feel SUPER Safer!  :shaka:  I can already feel it. That SUPER safer feeling! :geekdanc:

The most screwed-up part of this story is that the Criminal illegally carrying a firearm in a designated "sensitive place" CANNOT be charged with violating the law against doing that.

The Sensitive Places law only applies to Licensed concealed carriers:

Quote
§134-A  Prohibition against carrying a firearm in a sensitive location; penalty.
(a)  Subject to the exceptions stated in subsections (b) through (e),
a person granted a license to carry a concealed firearm under section 134-9
shall not knowingly carry a firearm on or into a sensitive location.
https://www.capitol.hawaii.gov/sessions/session2023/bills/SB1230_.HTM

The word "licensee" is used 14 times in that bill.  Every restriction regarding sensitive places is specifically tailored to include CC licensees -- not unlicensed people.

It's as if the government sees licensed firearm carriers as more of a threat than those who have not gone through the same training and background scrutiny..
The reasonable man adapts himself to the world;
the unreasonable one persists in trying to adapt the world to himself.
Therefore, all progress depends on the unreasonable man.

That is what some people call a "loophole" and the criminal exploited the sensitive places law.

Would be real funny if that part of the case gets thrown out because he was unlicensed and therefore did not break the sensitive places law.

Mo betta be unlicensed.

I'm old but fairly healthy,  However I don't GAS about Hawaii gun laws.
I do what I think needs to be done. I have a good lawyer on speed dial.

Rebellion is good, but you have to do it in a way that destroys the enemy.
