Did Trumps SCOTUS appointments help the 2A?
« on: September 26, 2023, 08:09:58 AM »
I was thinking about this and say another GOP won the POTUS, would their nominees have made the same decisions in Bruen?  There is really no way to know.  But what we do know is Trumps people opened the door to freedom of the 2a. Which means even though he made anti 2a comments like "take the guns first", based on results, he helped HI finally get CCW.

We know if Killary won, and she would have appointed anti 2a judges.

But also I guess timing met opportunity.  How many other POTUS were able to replaces 3 SCOTUS judges in a single term.

What I'm concerned is if any of the pro constitution judges retire and who's POTUS.

2024 election is important.

They all are important but strategically, 2024 is the one.

Cannot have another ketanji jackson or whatever that was that snuck into the SCOTUS.  Cannot even define what a woman is.  SMH.

SCOTUS is only one part of the puzzle -- albeit a very important part.

The appeals appointments have a bigger impact across more cases, since few cases ever reach SCOTUS for a hearing.

Combining the two, with appropriate weight given to the Supreme Court appointments, I'd say Trump outperformed Obama in judicial appointments in just one term versus two.

You can tell just how much the SCOTUS appointments meant by the calls from Democrats to try and pack the court with more justices.

There is more to the story which makes it hard to count the number of judges confirmed as a score of how good a president, or a party, is. A  party with a majority can still have their judicial nominations held up by leaders from the opposing party due to Senate practices.

We aren't talking about an overall score. We are just talking about the 2a right in this post.  Which is why I brought up Bruen and then later the 9th.  FYI the 2a cases that did go to the 9th were ruled on by a non 2a friendly packed panel. Including Young vs. Hawaii.

Yep.  Obama left a bunch of federal judge appointments unfilled for Trump to fill. if you listen to Trump, it was 128 vacancies.  If you listen to the fact checkers, it was 105.  Either way, it was significant.

The fact checkers blame a Republican Senate for blocking Obama's appointments, but that's not the whole story.

Whether it was a Republican Senate blocking the nominations or not, Obama had the responsibility to appoint judges that were nonpartisan, non-activists.  He had a 90% confirmation rate under a democrat Senate, which is nothing more than a rubber stamp to get Liberal judges in place.

Had Obama nominated more moderate judges, the Republicans would have been far more likely to confirm.  I think Obama was spoiled the first 4-6 years, and didn't want to compromise on his mission to flood the judicial system with Liberal judges -- even if it meant getting a 28% confirmation rate.

Throw into the mix that there was a backlog of vacancies left from the Bush administration, and Obama simply failed to capitalize on the opportunity to get his judges installed.

I understand that, my response was adding some context to Flapp's explanations on rates of judges approved.

On your topic I think Trump's SCOTUS picks did help the 2A. Certainly Hillary picks would not have been as friendly to us.
I think this is one of the few redeeming reasons to have picked Trump for president.

The 9th circuit is at 55% democrat appointments and 45% republican appointments due to Trump.  Before that it was like 65%/35%   More importantly Trump appointments were more.conservative than those chosen by Republican presidents in the past.  Normally the State senators recommend names for appointment and the president selects from the list.  Trump didn't do that with the 9th, he just selected who he wanted.

Tetter and Yukutake and another one (forgot) lawsuit appeals were heard by Trump judges in the 9th.
