There is no actual formula for assessing the value of any propoerty.

For most properties, you have to factor in "location, location, location."

A property would have to be compared to other properties with a similar size, age and amenities, all within the same general area.

How easy do you think it is to find another property that's comparable to Trump's properties (known for their lavish luxury), in the same general area, WHICH HAVE RECENTLY SOLD??

Good luck with that assessment!

If someone thinks square feet is the end-all, be-all of this issue, they need to try doing a market survey themselves.  It's really not that difficult or time consuming ... for residential properties or areas where business properties change hands relatively frequently.

This is also true, but according to EEF, Trump is an expert because he held him to the standard of "lying" about the property.  And ignored the lenders and their underwriters and SOP for high value loans.

What if , I get a text from someone who wants to buy my property. What if I reply with $1,000,000 cash and meet me in front the building tomorrow.  Would this mean that I'm over valuing my property and subject to fraud?

I have a general idea what my property is worth, but I'm not a realtor, appraiser, etc...

I have a general idea what my property is worth, but I'm not a realtor, appraiser, etc...

The realtor who sold us this house told us about the Japanese "Invasion" in the late 1980s.  The stock market in Japan had been on fire, to the point where it was getting tough to find any more stocks there that weren't already max'ed out in future growth potential.

So, the Japanese with all that money came to Hawaii.  As the realtor told it, a friend of his had been in the same house for 20 years.  One Sunday afternoon, there came a knock on the door.  It was a realtor.  After introductions, the realtor asked, "So, how much would you take for your house?"

The owner said, "If you're a realtor, then you already know this property isn't listed for sale."

"I know, but I have a client from Japan in my car (pointing to the man in his back seat).  We've been looking at properties and open houses, but as we drove by here, he said he really likes your house.  Seriously -- no joke.  If you had to name a number, what would it take to get you to sell?"

After a few seconds, he gave the guy a number that was what he paid plus a healthy return on investment.  They signed the papers on the spot, and the visitor paid in cash.

At that specific time, before house prices began increasing in part due to these investors, everyone in that man's neighborhood was upside down on their mortgages (owed more than they could sell it for).  However, after that man sold for such a huge amount, much more than the assessments had been, suddenly everyone in the neighborhood was able to refinance or sell for way more than their mortgage.

I guess those people should have been arrested for fraud, since the only reason their property values increased was because one man was able to sell to a randon buyer for much, much more than market value.

Such crooks and liars!!

That example doesn't work.  What you would have had to say is that HI has a law for selling something for more than it's market value, which we don't have. But thanks for playing.

Trump isn't a professional, even with sqft.  The lender would have to verify it if it's that important by sending out a professional to verify the sqft and correct as needed. 1 cannot just rely on blue prints either as whats on paper can also be wrong. I mean are you expecting Trump to go and measure the property and not even be 1ft off?  Cause whether he's 1 ft or 1,000,000 ft off, it's still not correct and you would think he's a fraud. Same goes with getting an expired meter ticket, 1 minute or 10 mins after the meter expires is still a ticket. Or 14ft away from a corner instead of 15ft. Or if cops were to enforce mag limits. 15rd mag pistol mag or 30rd pistol mag, are both the same level of illegal.

Trump isn't a saint.  I dont' expect any billionaire to be one either.  I would even call him an asshole at times, but he's the asshole we need that got stuff done. But this is just based off of his TV show and public appearances.  I have never met him, so maybe this is his persona he's portraying.  But from people who have been interviewed that have met him (regular folk), they all said the same thing "he's a lot nicer in person than what they thought".  And of course the fake news never aired this interview again. 1 was for the VEgas shooting when he visited the hospital, another was when he visited the veterans hospital, another when he was ordering burgers in Boston (IIRC).  Or would you rather have a nice guy who shits on this country?

Look at the facts, Trump wasn't off by a couple hundred square feet, the square footage listed was 3 times the actual size.
You are misrepresenting it by trying to paint it as subjective market value when the issue isn't value, it is square footage.

Comparing what he did to getting the square footage wrong by a couple feet is so ridiculous. You might as well drive 100 mph in a school zone and tell the cop your speedometer is broken and you aren't an expert in determining speeds. This is almost a worse defense than the previous one. So now Trump wasn't a liar, he is just so dumb he cannot tell the difference between a foot and a yard stick? I mean come on, if I were going to defend Trump I would at least pick a better argument that doesn't paint him as corrupt or incompetent. At the very least concoct an argument to the effect of saying that an employee filled out the form and he didn't know the employee put the wrong number.

I have heard from a number of sources that Trump was very reasonable in person. Also I agree that he made a number of good calls when leading this country. Having said that, I think he has demonstrated enough personal characteristics that, to me, disqualifies him from holding the office of president. A corrupt cop could pull me from a burning vehicle but I wouldn't then excuse his corruption.

Thought you might say that. I think CMO and I are similar in age so I wager we likely played some of the same games growing up.

In response  to those that said the loan was repaid so nobody got hurt. Where is the crime?

Lying of a loan application is a felony. If you speed and don't kill anyone or damage property it is still a crime.

Prove he lied.

So far, you haven't shown anything close to that.

Once again, property value assessments are as much subjective as objective.  Go read my other posts about real estate valuation factors.  You obviously failed to read them, ignored them, and/or failed to understand them.

You're a moron.

The judge that ruled Trump committed fraud and lied was presiding in CIVIL COURT, not criminal court.

There are no "penalties" in civil trials unless there is a statutory allowance for things like pain & suffering, punitive damages, etc.  Purely financial in nature, not like he's being found guilty of a crime.

Which Liberal Democratic Socialist Progressive website did you get your law degree from?

BTW, civil judgements are not grounds for barring Trump from running for office again.  Just so you know.

And on that note, maybe you missed the good news out of the Supreme Court?

Supreme Court declines to consider longshot bid
to disqualify Trump from running for president

Quote
The Supreme Court said Monday that it will not take up a longshot challenge to
Donald Trump’s eligibility to run for president because of his alleged role in the
January 6, 2021, attack on the US Capitol.

The case was brought by John Anthony Castro, a little-known candidate for the
Republican presidential nomination, who sued Trump earlier this year in an effort
to disqualify him from running for president and holding the office “given his
alleged provision of aid or comfort to the convicted criminals and insurrectionist
that violently attacked our United States Capitol on January 6, 2021.”

The case was denied without any comment or recorded vote.

so where's your name on the order, since "we" are determining the penalty...

The court order identifies Trump and other members of the Trump organization violated NY State executive law.

The certificates of incorporation were cancelled, a receiver will be appointed and Trump organization will be dissolved. The plaintiff one on the major charges.

There's always the possibility of criminal charges to follow. It's already been determined that they lied and committed fraud.

You have that backwards, genius.

If you lose in civil court, the judgement has no bearing on subsequent criminal prosecution.  However, if found guilty in a criminal trial, the evidence from that case goes a long way toward getting a civil judgement afterward.

hmmm.  Curious they went the civil route first ,,,

The standards of evidence are much higher for criminal court (guilt proven beyond a reasonable doubt) versus civil court (what's more likely based on a preponderance of the evidence -- 51% tips the balance either way).

So, you keep lecturing us on what's coming next, Perry Mason.  I'll wait for the movie.

Is Trump an expert on square footage?

So here's a good example. If a someone is going 1mph over the speed limit vs 10mph over the speed limit, are both still breaking the law?  And remember, 10mph over is 10X faster than 1mph over.

Thanks for falling for the fake news agenda again.

wow, he was convicted already?

I think what he is referring to is the judge's summary judgement that the evidence shows he lied, thereby committing fraud, so a trial was not necessary for that part.

Why are you doing such gymnastics to excuse Trump's fraud? Do you really believe Trump is that dumb to not know how to calculate basic geometry? Is he so bad at real estate that he thought he bought a 15,000 square foot property when it was 5,000 when he originally bought it?

Just admit it, this is who Trump is. How many times has he played these little games in the real estate market. Just like when he tricked people into thinking they had a higher up apartment than he had. Trump does not have any plausible deniability here.

Do you think every person caught with drugs simply claims they can't tell weights? "Judge, I didn't know I had 5 ounces, I thought I only had 3 grams..." That is not going to fly.

Thanks for playing with your poor example. You're missing how it would be 1 oz or 1.9999999999 oz of a schedule 1 narcotic is still illegal.

I'm not playing gymnastics, but instead trying to show you how to think for yourself.  Re-read what I posted. Do cops know how much horsepower an HPD cruiser is?  So you give the manuals HP answer and then it's dyno'd and you're incorrect.  Should the officer be charged with fraud?  How about how fast a cop was going prior to a deadly car accident?  Science proves it was faster which caused the death.  Is this fraud?

I cannot show you anymore how being wrong about sqft is nothing but the DOJ reaching for something or how loan underwriting works.  Are any underwriters going to get charged with fraud cause they approved the loan at said sqft?  Now IF he got the official sq footage document and whited out what a professional filled in, then it could be something.

I bought a 1500 sqft home in Virginia for $70K.

I also bought a 1500 sqft home in Hawaii for $400K.

Obviously there's no difference between two houses of the same square footage.  A lifelong real estate billionaire is obviously guilty of fraud for using a higher per sqft value than a more knowledgable judge.

If my son got the size of our house wrong by a factor of 3 I would say he can claim ignorance. If someone who prides themselves on a real estate mogul got the size of the house wrong by a factor of 3 I call BS. That is not a level of ignorance I think he gets to claim.

So you are comparing horsepower on an engine to the area of a rectangle? Talk about poor examples.

Like I said, if he simply came out and said an aid filled out the form wrong and Trump missed it then at least that is believable, but the "I don't know how to measure, I am not trained to use a tape measure" type excuse just insults our intelligence. I mean even if you like Trump that is an objectively bad defense.
