Oregon Ballot 114
« on: November 22, 2023, 11:33:43 AM »
Judge struck this down.

Like Maryland, OR passed a law that was multiple parts.

-Require a class to buy a gun. This was on hold previously as their police weren't ready by the time the law took effect on 7/1.
-"Large cap mags"
-30 day wait to buy a gun

The state failed to use "public safety", not because under Buren, they cannot.  But because OR has 1.6 million gun owners and over 800,000 high cap mags and these people aren't a danger.

The state also called in "historians" who said stuff. But with Bruen, this doesn't matter. What matters is what's on paper as law. The burden is on the state to prove what's on paper.

How this helps HI is if it gets challenged to the 9th, then a favorable ruling could do away with our classes needed.

I doubt the 9th would hear the mag portion as there is already a CA case pending in the 9th.  Once that's ruled upon, it would affect if the state appealed this portion.

The 30 day wait, I think HI has something pending since I remember Alan Beck being asked about our 14 day wait in court. I'll find out more about this one.

***Update

My mistake. THis won't go to the 9th first. It has to go to the OR Supreme Court first as this challenges the OR State Constitution, not the Federal Constitution.
