Why is anyone surprised by this?

A Pop Tart chewed into the shape of a handgun, outlines of guns on shirts and hats, and even pointing a finger-gun at someone have been grounds for expulsion from schools and arrest.

Adults have lost their damn minds when it comes to anything that somewhat might loosely resemble a firearm.

The only thing that's surprised me recently is that there's been no reports of gun haters calling 911 on concealed carry licensees.  I guess praise is in order for everyone carrying and not printing!   :thumbsup: :geekdanc:

Not really, if the custodian was certain he/she saw a gun and he positively identified the people he saw with a gun then police are justified in making the arrest because they have probable cause to do so and they are acting on good faith.

It is not uncommon for witnesses to make incorrect reports, not out of malice but out of misunderstanding or fabrications the brain makes subconsciously.

Based on the facts reported, the Cops that made the arrest are idiots.

If no firearm was present and there was no evidence other than a custodian thinking he saw a gun, there should have been no arrests, because there was only one person's statement to provide probable cause.  Even the witness said the gun wasn't being pointed at anyone, so how is that terroristic threatening?

According to one forum member, the cops investigate complaints on the scene (e.g. stolen cellphone at a bus stop).

I guess he will agree to disagree without offering any evidence supporting his position.

Do you have more info than what the newspaper posted?  Seems like a common he said, she said type of thing.  And in the meantime, someone was arrested and put in holding (aka jail) and then later released.  Did the person miss work because of this?  What if this was a legal CCW holder, would their CCW be revoked or would they have trouble renewing it the next renewal?  I've seen HPD deny returning someones firearms, even though a judge released them to the individual.  They had to hire a lawyer to get them back, which means more cost.

How did the custodian see the gun when the car was driving by?  This would be he was at the edge of the road and just to happen look into a car as it drove by.  Unless the guy was holding it outside the car window pointed down toward the road or something.

By face value of info available to the public, seems like the cop was over zealous.

A firearm does not need to be located in order to establish a firearm was part of a crime. If I rob you at gunpoint but you ditch the gun before cops catch you do you believe that means you can only be charged with robbery 2nd as opposed to robbery 1st? (Robbery 1st involves a weapon)

The article contains very little information on the specifics of the case. We don't know whether he said he thought it could have been a gun or if he said he was certain he saw a gun. If in fact the custodian said something to the effect of "he was holding something and it kind of looked like a gun" then yes it would have been a bad arrest if there was no firearm.

You are fond of pointing out when people who were never in the military comment about something in the military so keeping with that, please tell me how much law enforcement experience you have.

Very valid questions, unfortunately the article gives very little in the way of details. It could have been they did their job poorly but it is also possible the circumstances were such that they were justified. Without knowing more it is impossible to fairly judge their decisions.

Either they were waving the thing around or the custodian is Superman in disguise (x-ray vision).

So if he isn't superman, then why do you suppose those guys were waving the thing around, or at least holding it up so one can see it through the windows?
