HPD explanation of the incident.

Birds eye view of incident here.

When I first read about this in the news, I first thought that it was some kind of shoot out.

Sounds like the soldier was unarmed when he got shot by 3 officers.  Justified shoot?

News reported that police found a "replica" handgun in his truck?
I think, therefore I am armed.

From what appeared in the news reports, my opinion is for the first shooting, I think it would be justified as he was a danger to others on the road.

However for the second round of shooting, he was boxed in and appeared to be trapped.  That one is questionable if he was only damaging property(police cars).  If it appeared he could break free then shooting should be justified as he is a threat to others again.

Tragic ending. Justified. He tried to run over police officers. A vehicle is a weapon.

Looks justified based on initial reports. HPD Policy on the use of deadly force:

Police officers may use reasonable force to effectively bring an incident under control, while protecting the lives of officers and others. All applications of force shall conform with the constitutions and laws of the United States and Hawaii and the legal statutes of Hawaii.

Three factors are involved in determining reasonableness:

Severity of the crime: The more serious the crime or severe the offense, the higher the justification for the use of force. An individual's right to privacy and physical integrity will be weighed against the police department's legitimate interest in taking action against the person.

Level of threat: The more immediate the threat to the safety of the officer or others, the higher the justification for the use of force.

Subject's behavior or level of resistance: The greater the level of resistance, the higher the justification for greater use of force.

I always love the silly argument of why not shoot out the tires or shoot him in the arm.  I bet thoes people who say that have never fired a gun before or ever try to shoot a moving target with something the size of a dime at 25 feet away

It's sad.

It is however justified.

His reckless disregard for authority and public safety caused his death.

The officers were very patient and you could hear them yelling for him to stop and to get out of the car.

The kid, unfortunately, disregarded the officers and escalated his reckless behavior.

Your number one Option for Personal Security is a lifelong commitment to avoidance, deterrence, and de-escalation.

Someday someone may kill you with your own gun, but they should have to beat you to death with it because it is empty.

Because of this incident I am going to start pushing legislature for a pick up truck ban.  Pick up trucks have caused way to many deaths!  They have indiscriminately killed people of all ages in the US and the world.  Assault pick up trucks will be defined as any motor vehicle with a cargo bed and four wheels.  Pick up trucks with 3 wheels or less will remain legal under this ban.  I personally know two young children killed by a pick up truck on the Bid Island.  This senselessness must end!

I would like to add to this legislation of assault trucks. I would like to ban trucks with one or more assault feature such as rims larger than 14 inches (man killers) , Four-wheel-drive (for beach assaults and off-road assaults), toolboxes ( bomb storage), tinted windows( clearly shows gang affiliation) Black trucks and green trucks ( scary looking), crome plated bumpers(MAN killers), tow hitch (to spear innocent pedestrians) and any lift ( clearly it makes it easier to run over people)

IN ALL SERIOUSNESS THOUGH THIS IS A REALLY SAD EVENT AND IT SUCKS THAT IT HAPPENED
