§134-C  Possession of assault weapon prohibited.  (a)  Any person who, within this State, possesses any assault weapon, shall be guilty of a class C felony.

Thats how I interpreted it when I read it, unless I'm misinterpreting...can't own them, period.

So then...what do we do? Does confiscation infringe on our 2A rights? Would the NRA would bring this to the SCOTUS if they indeed pass this? I mean, NY didn't even propose confiscation. Who's got our back on this?

Maybe someone who is well connected, could possibly send this to a network like Fox for consideration. I could imagine someone like Hannity or some others airing this since it clearly infringes on the 2nd Amendment.

Regarding the process, what kind of timeline are we talking about?   Is there a point at which it (the bill) can get bogged down & buy gun owners some time?   And finally, is there anyone on the side of the 2nd Amendment in either the Senate or House?

Bottom line, what can I do as an individual & what can we do united?

Those are all good questions but your bottom line is extremely important.

That's how I read it too. I re-read it a couple of times before posting just to be sure, yet still hoped that I was incorrect.

Ain't much in my wallet but this makes me want to empty it into whatever the most effective lobbying organization is going to be.

I'm not a "no more gun control!!!" kind of guy, exactly, but this is just stupid. Hawaii is already the 3rd least gun violent State in the Union (Behind Vermont and New Hampshire, which is fascinating.) What problem is this legislation trying to solve?

edit- corrected statistics.

So, I'm reading that a stripped lower receiver not named in paragraph 1 and as long as we don't have all the parts to assemble or the same person doesn't have all the parts to assemble is legal to own?
The Supreme Court has ruled that you, as an individual, have no right to protection by the police. Their only obligation is to protect "society".

FFL transfer and pay the shipping.

BEFORE the law is passed. The way it is written, I think, doing this after the bill is signed into law is illegal. Shoddy writing, that. The way this piece of crap is written we'd all pretty much become felons as soon as the governor's pen left the page. Meaning no grace period, no waiting for the law to take effect after it is signed, no provision for legal out of state sales. If you have a firearm that meets this definition of "assault weapon" you are instant felon upon the signing of this bill. Your only option is to surrender the weapon for destruction.

This is by far the most disturbing legislation I've seen to date... :(  Don't know about you guys, but I'm passed pissed off that something like this is even proposed.  I hope people get wind of this and come out this Saturday.  Man this really leaves me with a feeling of hopelessness  :'(

This is who introduced the bill... but states on the side  (Introduced by request of another party)  Anyone know what that means?

Senator
Ihara ,  Les Jr. (D)
Hawaii State Capitol, Room 220
Phone 808-586-6250
Fax 808-586-6251
E-Mail: senihara@capitol.hawaii.gov
S District 10
Kaimuki, Kapahulu, Palolo, Maunalani Heights, St. Louis Heights, Mo‘ili‘ili, Ala Wai

Ok, so I'm done pouting.  I need some help with this, but can't we write to the senator of our district to report our concerns?  Does anyone know how to start a petition to stop this bill from being passed?  For now couldn't we contact our representatives directly to oppose the hearing, therefore stalling the bill?  I'm just trying to be proactive...

*for people like me who have a hard time understanding how legislation works found this (hope it is accurate)

Well, "happening" is subjective. The bill hasn't gone very far down its convoluted path to becoming a law so nothing is "happening" as of yet.

The law IS in process, though, and if we don't muster enough opposition to it it may well pass. Looks to me like the dickheads in our State legislature may be trying to compete with NY to capture the national stage. Hawaii prides itself on being progressive and this is would be an affective and high profile way to demonstrate that yet again. Especially after losing Inouye they may be trying to get some leverage in D.C. by being aggressive.

edit: it might also just die in committee. Lots of bullshit legislation gets introduced to make a point and never gets anywhere.

this just scares me because i cant think of a single person in the legislature off hand with a record of voting on something like this.

i have absolutely no idea where we stand, good or bad.  all i know is our state is liberal as hell, and a whole lot of our national representatives dont like guns.
