SB219: Retroactive felons?
« on: January 20, 2013, 11:49:43 AM »
I know there are a few 2A members that have a good grounding in law.

Seems to me if somehow this joke of a bill passed, it would make felons retroactively of citizens for possession of something that that was 100% legal before.

Isn't there some Constitutional (hah, as if that matters to liberals) protection from laws like this that would have this quickly slapped down in the courts?

Even the 9th Circus has to pay a little attention to the law and not political wind direction.

as someone else posted earlier, it may be unconstitutional and the courts may strike it down, but that takes time and money and effort and resources.  And while it goes through court it is still a law.  So although it might be removed, our efforts should be put into attending scheduled meetings, submitting testimony in person as well as online to make sure these never make it into law.

I read it a few times but I'm certainly no expert so I had a few friends take a look (LEOs, Lawyers, Lawmakers)... As SB219 is written, with no grandfathering, amnesty, or compliance time line, you would become a felon.

Bass Monkey's 100% on... All of us really need to put forth a max effort to keep this unrealistic bill from becoming law

And if it matters, most of the folks who took a hard look at SB219 all said the same thing... It's poorly written and looks as though someone did a lot of cut & paste.

Even if trusting souls did turn in stuff hoping for a court overturning the damn thing, what do you think the chances are of ever getting your property back are?

Sounds like a lot of stripped receivers will be sent off to safe haven first, then.

Edit:  And then, obviously, requested for return later.  Plan ahead Brahs......

Since we are all law abiding citizens and have all those recievers registered, all they have to do is slap the chrome cuffs on you for refusing to turn them in. Then the court battles commence. While you sit as a political prisoner and dissident.

If this becomes law I'm sending my guns out-of-state or going to throw them in the middle of the Pacific Ocean... what sounds better... ;)

This bill was apparently written by one of Ihara's constituents - which explains why it is so poorly written.

Props to Ihara for his policy of representing his constituents by passing their legislation suggestions directly to the legislature.

Without the political will of any Senators to walk it through the chambers this bill is unlikely to get anywhere. Not that we should relax our efforts.

Might want to read the other thread about the AWB bill and have a look at the other general legislation threads. There already are such bills. Introduced by Slom, I believe.
