I thought ny had a 10 rnd ban in place already? If so, you could argue that the law enforcement officials were justified. Isn't the new ban an issue of 10 rnds to 7 rnds?

Yes, they already had banned 30 round mags and have a current 10 round limit.  That is why their violent crime rate is one of the lowest in the Nation
It is what it is.

Well, it says he was arrested over yet to be enacted ban, yet owning a 30 rnd mag is illegal as it is. So was the arrest justified, or not?

30 rounders were grandfathered if owned before the ban.  under the new ban, they wont be.

Before we don the tinfoil hats or get all 'militant', consider the source of the article (a survivalist site) and that they simply got it wrong. Fact is, New Yorks "new" law does not go into effect until April. Under their current law (since 2000), magazine capacities are limited to 10 rounds but preban standard capacity mags are allowed.  And this whole preban vs. postban is where it all gets sketchy, because unmarked/undated magazines can be pre-1994 OR post-2004. If SSG Haddad didn't personally buy the mags before 1994 and didn't do his due diligence in verfying date of manufacture? He may well have broken the law.

As for the how's or why's for the search. For all we know, it might have been by consent or the mags could have been in plain sight. If it was an illegal search, the exclusionary rule will get the evidence and possibly the case tossed out. Regardless of which...with the limited information it's pointless to speculate or get worked up over it.

I was reading the comments when I came across that he was in a constitution free zone, (any place within 100 miles of a border), and anybody in that zone has no constitutional rights. There is a link to check if you're in a zone it goes to the ACLU website. All of Hawaii is in a zone. So we have no rights.

There are “Constitution-Free Zones”, a 100 mile-wide area that forma a perimeter around the USA, a zone in which our Constitutional rights do not apply.§ 287 (a) (3) of the Immigration and Nationality Act, 66 Stat. 233, 8 U.S.C. § 1357(a)(3), which simply provides for warrant-less searches of automobiles and other conveyances “within a reasonable distance from any external boundary of the United States,” as authorized by regulations to be promulgated by the Attorney General. The Attorney General’s regulation, 8 CFR § 287.1, defines “reasonable distance” as “within 100 air miles from any external boundary of the United States.”

Yes, CFZ's are real. But people making those comments just want to add to facts that aren't there or twist things to make it more ominous. What is clear from the multiple sources I've looked at: 1) Haddad was stopped by a local Sheriff's department, not a Federal agency. 2) It was not DHS checkpoint/roadblock. 3) He had 5 "illegal" magazines in his vehicle (some sources say they were loaded with ammo). So I'll repeat: If the search was illegal, any evidence is considered "fruit of the poisonous tree" and will get the case dismissed.

Your conclusion that Hawaii residents (or others in the zone) have no rights is just incorrect. Constitution Free Zones under 8 CFR 287.1 applies to immigration checkpoints/roadblocks manned by Federal agencies. So until they Federalize HPD or DHS/CBP/ICE set up shop on island roads, we DO have rights. Please save the tinfoil for leftovers.
