Selling a pistol to an out-of-state family member.
« on: April 25, 2013, 02:36:01 PM »
Why does the State of Hawaii make selling a pistol to an out-of-state family member such a pain? According to a lgs FFL, the lgs has to apply for a permit from the state just to legally ship it out to my brother's FFL while charging around a $100 to do so. I have no problem with the lgs charging for their time, but I do have a problem with state using up the lgs time so they have to charge just  to apply for a permit for a pistol going to Virginia.

If the FFL in the state of your family is OK with it, you could send the firearm straight to that FFL.  Who told you it's going to cost $100...........Tony?

A local shop that does not have a Tony. I will ask around what the transfer fees are for other places.

This is exactly what HPD told me when I inquired. No requirement unless the receiving state requires it.

Interesting, I will inquire with HPD when I am there on Tuesday for registration.

Thank you and Gzire for the tip.

You can ship it to an FFL that accepts out of state transfers. You will have to ship it fedex next day air.

I believe that someone with an FFL may ship handguns via USPS and that you only need to ship via fedex or ups overnight type of service if mailing say a handgun from hawaii to yourself in another state. I may be wrong but I think that is how it worked when I was looking into how I was going to get my handguns from the east coast to hawaii when I moved.

You're right in that that FedEx Priority Overnight shipments take at least two days instead of one to the East Coast. But, they charge you as if your package gets delivered in one day - despite this issue. Talk about unfairness to gun buyers.

Hey Paul please PM me the name of the shop.  I'd like to know who is putting out this kind of info.

As far as local FFLs, I don't think anyone is cheaper than Big Al (I think he's still $30/transfer).

Qualifier:  unless you are eligible for the LE/Military discount at OGC, then the FFL fee is $25/firearm!

Check with Al on his price. He has to go down to HPD and meet you to transfer it to him. I think he charges more for this service

My point was not meant to be a hit towards any FFL, so far I have received great service from each that I have visited. I understand that they are providing a service for their time and that hey should charge according to what they think their time is worth. With the previous length of lines over past few months, going through two weeks of permitting and three separate trips to HPD for each pistol transfer sale to the Mainland would personally make me charge a premium to preform this service. The main point that I was trying to make was that the problem is the state requirement that the pistol be transferred over to the lgs in the first place before they can send it out.  Granted the paperwork does help show that the pistol was legally separated from the seller's possession, but you would figure that the FFL log that the ATF requires the lgs to vigilantly maintain would be valid form of paperwork to meet the state's records.

I was inquiring because (1) the $100 seems a bit excessive and (2) the incorrect information about the transfer is not good coming from an FFL who should know better.......it's worse when they pass on this incorrect information to customers.

Keep in mind that most FFL's will only go down once or twice a week to file their paperwork with HPD.  No reasonable FFL is going to go to HPD every single time there is a transfer for that week, unless you want to make a point with one of your employees.  As far as the ATF paperwork........once your system is set up I can't see it taking more than what 10 minutes per transaction............so $100/10 minutes............$600/hour is pretty bad.

Just wanted to share what I found out.

I have confirmed SpeedTek's, and others, idea of: "Any person may ship firearms directly to a licensee in any State, with no requirement for another licensee to ship the firearm", per Question number 7 on the BATF's webpage: http://www.atf.gov/files/firearms/industry/0501-firearms-top-10-qas.pdf, to a FFL in another state where it is allowed.

As for shipping, again they do have to be shipped overnight, but UPS/FEDEX will ship overnight if the package is within their possession at the Lagoon Drive location in Honolulu prior to 8:00am. You also will have to verbally state to the shipping representative that your package does contain UNLOADED firearms. To quash any problems, it is recommended that you should print out the BATF pdf page and bring it with you to the shipper. You are also allowed to ship multiple pistols within one box. Do not place any indications on the outside of the box that it does contain firearms. Unloaded magazines are allowed to ship with the unloaded firearm, however any ammunition of any form or package is NOT accepted.

I would just like to say thank you to all that helped this thread along, and hopefully it will benefit all of us.

Mahalo,

Paul
