As of today, you are past due on the agreed lease rent for a prorated share in December, All of January (Plus late fees & taxes), All of February (Plus late fees and taxes) and All of March (Plus Late fees and Taxes). The total amount NOW DUE is $14,189.70. This amount needs to be paid immediately. You were served with a 5-day demand letter on 2-14-17. You indicated you would make a payment on 2-17-17, On Monday 2-20-17 you stated you hadn’t caught up with “The Guy” who had written the bad check and he wasn’t returning your calls.
On February 27, 2017, you had indicated you had received a loan and it would fund on 3-1-17 or sooner (“possibly today”) You further indicated the total due past due would be paid in full. On 3-3-17 you indicated that your loan had not yet funded but you would be returning with a $5,000.00 “Cash” Payment. Samson and I waited until 6:30 PM you did not return. On Monday 3-6-17 you told us that your “attorney” had picked up a check for more than $20,000.00 and the “Bank would not allow you to just withdrawal $20,000 in CASH, you had to schedule that” – Your Words. I told you on Monday 3-6-17 that your time was up and we would not except any MORE EXCUSES, you needed to go over to the bank and get a cashier’s check. You said you were going to the bank to get a Cashier’s Check and NEVER RETURNED!
You were served a 5 day notice to pay on 2-14-17 YOU FAILED TO PAY.
You were served a notice of breech for cause along with a 45 day notice to vacate by April 1, 2017 on 2-24-17.
On 3-13-17 an additional notice of Breech and Notice to vacate along with a current invoice was taped to your door and photos of the posted notice and invoices were recorded. You removed the notice @ 8:20PM on 3-15-17 (copy of surveillance video logged).
THIS NOTICE DATED 3-22-17 IS ALSO SERVED BY PLACING IT UPON THE DOORS OF THE RENTAL UNIT.
Failure to make payment in full and vacate by April 1, 2017 will resort in additional expenses in filing documents with the court and perusing all legal remedy to recover damages.
YOU MUST VACATE THE PREMISES AND DELIVER UP POSSESSION BY: April 1, 2017
All rents are due and fees continue to accrue until payment is received in full.
