Title: CA preventing residents from rebuilding
Post by: ren on January 27, 2025, 10:38:05 PM
sound familiar? look familiar?
https://recovery.lacounty.gov/returning-after-fire-faq/

When can I return to my property?

It will be several days or longer before residents in heavily impacted communities can begin returning to their properties. Inspections, search operations, and assessments are being conducted as quickly as possible to expedite residents’ safe return to their properties.
I just want to see my property or retrieve something special. I just need 15 minutes.

Unfortunately, too many dangers remain to allow you to return to your property safely. Downed power lines must be cleared to avoid the potential for electrocution when lines are reenergized. Hazardous materials from burned homes must be assessed and removed as overseen by the EPA to avoid health risks to you and your family. The Fire Department must make sure that all small spot fires have been extinguished. Sadly, in some cases, we are still searching for remains. All of this work must be done before we can safely allow you to return to your property. Resources are being poured into the field from federal, state and local partners to help complete this as soon as we possibly can. We know how important it is for you to begin the recovery process.

in college, my apartment was in a complex that was destroyed by a gas explosion.

Luckily my building was still standing, but enough of the force hit it to break all the windows, knock everything on shelves into the middle of the rooms, shattered overhead light fixtures, and even split the doorframe to my bedroom door when the door was blown open -- all while i slept under the window facing the explosion.

That was just before 7am IIRC.  I was able to grab enough clothes for the night and my toiletries.  We were unable to go back into the complex for 3 days to give the engineers time to decide which buildings were safe enough to enter.  The building next to mine where the laundry room was located was rubble.  Several apartments had second story floors collapse down to the first floor.  Walls had cracks, glass was everywhere, and there was no electricity.  All the food in the fridge  i'd bought 2 days earlier was wasted.  I still don't know how I walked through the entire apartment barefoot to check for my roommates without getting a single cut.  My bed was filled with the broken window glass.

All this to say, it's not always a simple case of "running in to grab a few items," when so many things could represent a danger.  Until you know, you really don't know.

Mormon church tells their people to have a suitcase/bug-out bag packed with supplies to last 3 days.
When I was growing up, we had one.
When I started having a family I had one.
I kind of forgot about it in more recent years.
This was a good reminder to check yours or make one.

Common sense tells people to have a suitcase/bug-out bag packed with supplies to last 3 days.''
''This is a good reminder to check yours or make one.''

   Greatest disaster most likely to occur is house fire.
   Would be nice to have a "Go Bag" with some clothes, cash, car keys, meds and toiletries as well as a flash drive of all important docs and pics to be thrown out the window before you when wake up and the house is on fire. :thumbsup:
How to decide to pack such a parcel is stand in the middle of your living room butt naked and say to yourself "I'm leaving in 60 seconds and never coming back".

I have a small bag in the safe just for that but it is mostly cash, documents, and a pistol, and the hard drive backup if I remember to grab it. Would be smart to get a bag with some clothes too.

Officer I am transporting this firearm to my new place of sojourn.

When your home is on fire, you won't immediately go to a new place of sojourn.  You will be stopped and talking to first responders or others.  Or if we use the above example or Maui, you're immediate goal is to escape the fire in any direction that you can.

So no, you are not transporting this firearm to your new place of sojourn yet.

So, your first inclination when caught breaking the law is to lie to the Cops?

An officer stopping me doesn't mean I am not on my way to my place of sojourn. If my town burned down I would head to a family members house on the other side of the island no matter whether I take the most direct route or not.

I guess some people have blanket approval to soujourn at a relatives home without having to stop and ask for permission.  Which would be violating places to keep while they're on the phone asking permission.

So as soon as your home is on fire and you grab your bag that has important stuff on it, you will immediately go to a hotel? Not stop to talk to any HFD or wait for them to arrive?  Not do a head count outside to make sure all your household members don't require medical treatment, see if anyone else needs help, etc....But grab your bag and head straight to the hotel/relatives home.

Just admit, you're trying to move goal post now, instead of admitting you plan to break the law.

You really think stopping your car after fleeing your burning home to do a head count and make sure no one is hurt is going to be a charge of illegally carrying a firearm?

By your logic if I have a heart attack on the way to a gun range and I drive to a hospital I will be committing a felony.  :crazy:

https://www.hawaiinewsnow.com/2023/03/31/honolulu-mayor-blangiardi-sign-bill-that-would-restrict-guns-sensitive-places/

Under the new law, concealed-carry weapons won’t be allowed at a hefty list of “sensitive places.”

Those include:

    City-owned buildings;
    State and federally-owned buildings;
    Schools and child care facilities; public parks;
    Shelters, including homeless and domestic violence shelters;
    Places frequented by children, including the Waikiki Aquarium;
    Polling places;
    Public transit;
    Businesses that serve alcohol;
    Large public gatherings, including protests;
    Concert venues;
    Cannabis dispensaries;
    And hospitals.

The “sensitive places” law was the culmination of months of work following the Supreme Court decision.

“We’re not a gun carrying society and we’re not gonna do anything that’s gonna condone that,” Blangiardi said.

Yup, so even if you have a CCW and you need to go to the hospital for X reason, you cannot CCW. Including if EMS transports you there.  The hope would be is if EMS disarms you before hand.  But now, is EMS violating state law about possessing a firearm?  IDK if there's an exclusion for them.

If you choose the most restrictive and literal interpretation of the law then yes but realistically speaking that is not what the law was intended for and no one would be prosecuted for it.

It is only a word salad if you don't understand the difference between a strict literal reading of a law compared to understanding what the law meant to accomplish.

Yes, I am saying it is not a crime because that is not what the law actually means. If you break a window to save a child from a hot car you have technically broken the law but realistically it is not a crime, you would not be arrested or charged. If you have to resort to a ridiculous technicality to try and win the argument then that isn't much of a win.

You want to win an argument with an overly literal and unrealistic reading of the law? Ok, you win.

Regardless, my initial comment about having a gun in a to go bag is not a violation of the law no matter how you try to read the statute because I would in fact head to a relatives house to stay.

Do you have a list of laws and ordinances the Cops will not enforce?  Because that would be very useful for those of us who try to follow the statutes -- ALL of the statutes.

If there is no list, and it's all an unspoken list of unenforced laws, then it's you who wants to win an argument using an undocumented, unsupported and unrealistic "fact" -- that the law itself doesn't exist if it's not enforced with or without the public's knowledge.

It ain't illegal if you don't get caught is more of an argument than what you posted.

I would call that a crime and so would a few others here. So your statement of "realistically no one would call that a crime" is still wrong.

"Yes, I was wrong and would be breaking the law.  You guys are correct as the HRS states what it states".  This is all that's needed, but instead, you will dig deeper trying to wiggle out of being wrong again, like usual.

What if the person was trying to commit suicide?  Could/would/can they want to press charges for a broken window?

Vs. you dragging someone out and they declined to press charges because you saved their life.

So yes, it can be a crime to break a car window and pull someone out of it if it were on fire.

Can you post the HRS that list the exclusion about property damage or a good Samaritan law about property damage exclusion?

thanks for finally admitting you are a cop...

Funny, I don't recall seeing an exemption for being a cop in the criminal property damage statutes...
You are avoiding the point of the question... Would you consider yourself a criminal if you broke a window to save someone from a burning car?

I admitted nothing.

You avoided answering the question, does that mean you admitted I was right?

Non sequitur. Giving up because it is pointless doesn't make me wrong or you right. Try again.... actually don't.

Are you saying I can determine whether or not I broke the law aside from what anyone else thinks?

Nice to know that whatever I consider myself is more important than what a prosecutor would think.

Cool!   :geekdanc:

You really think stopping your car after fleeing your burning home to do a head count and make sure no one is hurt is going to be a charge of illegally carrying a firearm?

By your logic if I have a heart attack on the way to a gun range and I drive to a hospital I will be committing a felony.  :crazy:

You sound like the HPD LT. who was at the hearing yesterday about places to keep gun parts.  He said something like "do you really think if someone is carrying a spring (gun spring) that they will be charged?" Eventhough, that's what the bill says. Same guy also said that carrying a lower receiver cannot be charged with places to keep.  So I guess one can buy a gun from a gun store and as long as they disassemble it in some manner so the gun cannot fire, they no longer have to go straight home.  Same with going to and from the range, now you can stop and get lunch and leave the gun in the car.

I question this Lt. knowledge of the law and the DLE acting chief's one as well.  Good thing the internet is forever and one can use this as a defense to violating places to keep.

Yep.  Claiming a law is not going to be enforced should not be an argument for passing that law (or keeping it), but rather demonstrates they are wasting our time and money passing laws that will do nothing for public safety.  It would only allow for prosecutors to add more charges after someone is arrested for real, enforced crimes.

It's not up to the public to know if a law is enforced.  We are supposed to follow all laws.  Laws that are not enforced should be repealed.

Trump was tried and convicted of violating laws that no other developer in NYC has ever been accused of.  So the theory that a law "will not be enforced" is more wishful thinking than truth.

I asked if you would consider yourself a criminal and you said no. If you broke the law are you not a criminal?

Criminal is an adjective that means relating to, involving, or being a crime. It can also be used as a noun to refer to a person who is guilty of a crime.

I asked if you would consider yourself a criminal and you said no. If you broke the law are you not a criminal?
