I have actually bought this up before, Hawaii is a may issue state (for CCW and Permits) , If you are not eligible for a permit, You are not eligible to own firearms (that is how they confiscated my shotgun).
Even worse, the Chief can revoke your permit at any time

My question now is if you have no active/current permit to acquire, can they still 'revoke your permit' and come get your stuff? ???

I am still unclear if they will be able to force retroactive compliance?

Not having a PCP doesn't mean you have NO doctor.  It means you have no PRIMARY doctor.

Different animals.

When they ask for your doctors information THATS WHO THEY ARE ASKING FOR. The fact that they were sending the forms to Kaisers insurance office is/was illegal to start with,

Need to renew my long gun permit, but my GP at Kaiser just retired.  never had an issue last time with a handgun permit and him (or whoever at Kaiser) but with this new BS, I am reluctant to have any dealings with the PD at all.

Got to suck for the shop owners if gun people start to avoid the whole parerwork debacle due to unknown repercusssions of this BS law environment.

Tempted to just sit it out rather than give the bastards some excuse like London808 ran into.

no need worry about your PCP retiring, bc the letter doesn't even go to a doctor, Kaiser's records department handles it
if you never went to see behavioral health or a psychologist at Kaiser, then you dont need to worry.  (but dont quote me)
they'll only red flag you if you saw a psychologist at kaiser

the kaiser form does not ask for your doctor, only your soc security number and name, they'll look up your records from there

And Just to make it even clearer, The law requires you ti sign the form,  you dont have to give any other information

§134-2  Permits to acquire.

(c)  An applicant for a permit shall sign a waiver at the time of application, allowing the chief of police of the county issuing the permit access to any records that have a bearing on the mental health of the applicant.

That might not be for your doctor.  There is another Mental Health form that goes to the state mental health office.  That one is just your personal info and a signature.  No doctor's name.

They need a form signed for each because of this law, But again the only thing you are required to do is sign the form (and the part that identify yourself)  Just because the other information is on the form it does not mean you have to fill it out.

[§134-3.5]  Disclosure for firearm permit and registration purposes.  A health care provider or public health authority shall disclose health information, including protected health care information, relating to an individual's mental health history, to the appropriate county chief of police in response to a request for the information from the chief of police; provided that:
     (1)  The information shall be used only for the purpose of evaluating the individual's fitness to acquire or own a firearm; and

     (2)  The individual has signed a waiver permitting release of the health information for that purpose. [L 2001, c 252, §1]

So, you just agreed with my original comment.  You have to sign the waiver for Kaiser to release records even if you have no PCP name to provide on the form.  You are waiving privacy rights on your Kaiser records no matter what.

Yes and No. the form asks for your doctors name and address not your health insurance information, So when you fill out the form you should be giving the doctors name and address and not Kaisers information.

HPD should not be asking who your insurance company is, they should be using the information on the form provided.
They should also not be asking for a doctor to clear you for firearms ownership. They should only be asking for a doctor to say if you have a medical condition that would prohibit you from ownership.

The guys at the window give you a Kaiser form if you have Kaiser insurance.  It looks pretty much like the same form you sign to get copies of your own record or release info to an other hospital.  All they need is your name and birthday, but I think it asks for your Kaiser member number, too.

If I feel like it I look up the location address and phone number for my Kaiser clinic, and put that for my doctor's contact infoi.  I was also between PCPs twice, so there are times I put NONE for the doctor's name.

Once you provide your basic info and sign the form, refusing to list a doctor won't matter.

It's like arguing the law permits you to wear a blindfold while being executed.  Being right won't change the outcome.

Maybe I missed something but have we heard if it is retroactive to all current owners?

No surprise but Major Robinson never answered me back.  I chalk it up to another public official that does not think he has to answer to the public.  Says a lot about the man and his beliefs.

I will call the AG tomorrow and ask. I have to pick up a permit/register a pistol tomorrow so i will ask at HPD as well. Wonder if they will threaten to arrest me this time.

Good luck.  The only reason people do not answer pointed questions is that they have something they do not want everyone to know.  This law was vague on purpose so the AG can enforce a much broader interpretation of it that good ole Major Robinson wants.
